Frequently Asked Questions

How quickly must I hire an attorney?
You should not feel pressured to make an immediate decision about pursuing a claim for compensation.  However keep in mind that each state imposes a deadline for lawsuits to be filed.  This deadline is known as the statute of limitations.

What should I look for when selecting an attorney?
You should research the firm before you consider hiring one of the attorneys.  In deciding on representation, families should seek a lawyer that has substantial experience in successfully handling similar cases. It is important to not only verify the reputation and experience of the law firm as a whole but to be sure that your case will be handled by individuals with appropriate experience. Finally, some cases can be extremely expensive to litigate and the firm you choose should have the resources to conduct the case through trial and appeal if necessary.

Is there a charge for my case to be evaluated?
There is no charge for our review of your case. If we decide we can represent you, we will discuss our contingent fees (calculated as a percentage of the recovery we obtain) and provide a written contract for us to agree on.

Will I need money to get started?  How do I pay my lawyer?
No.  We handle most cases on a contingent fee basis, which means we do not get paid unless you make a recovery. We advance the money for expenses incurred during our representation while a case is pending. If and when your case reaches a successful conclusion, the money our firm has spent is repaid out of your recovery. This recovery from the wrongdoer normally includes our cost of litigation. We explain the full details of the fee and cost agreement you have with our firm before we begin representing you on your claim.

Will you come and meet with me or will I need to come to your office?
It is your choice.  We meet clients regularly at their homes or places of business. We would also enjoy meeting with you at our offices. We can travel to you no matter where you are located.  When needed, we are able to schedule appointments at night and on the weekends.  If necessary, we will also come to the hospital or healthcare facility.

What can I expect from my first appointment with your personal injury attorneys?

You will meet with one of our team of experienced personal injury attorneys at the time of your first appointment with our firm. Our attorneys and staff are professional and courteous, and we do our best to make you feel at ease. We allow plenty of time to meet with you and discuss your potential claim. We will discuss the facts of your case and explain the personal injury laws as they might apply to your case. Based in Tennessee, our lawyers handle cases throughout the country and the initial consultation with our team is always free.

Do all cases go to trial before a Judge or a Jury?  Should I settle?

No. Over 95% of cases across the Country are settled prior to trial.  Today many cases are resolved quickly through other forms of  dispute resolution such as mediation and arbitration. We will discuss all available options with you.
Accepting a settlement offer can be a difficult decision. We always present you with the pros and cons of settling your case before trial. We provide you with information regarding the fairness of the settlement offer, but the final decision is always yours. Your lawyer will explain clearly to you the factors which play a part in evaluating your claim. Your lawyer will make recommendations to you and try to clearly explain to you the reasons for the recommendations. Since our lawyers have experience in settling cases and know what juries and judges generally award in a similar case, clients usually follow our recommendations.  But again, the final decision is always yours.

Who will I sue?

That depends on the facts of the case. In order to maximize your chance of success and recovery, we investigate the conduct of all potential defendants. It may be that the wrongdoer is not sufficiently insured and your own uninsured or underinsured motorist insurance coverage may provide extra compensation for your injuries. Further, the facts of a particular case may dictate investigation into the conduct of others such as vehicle or machinery manufacturers.

How long will a lawsuit take?
We cannot give any guarantees. Each case is different. In some instances, a case will settle to your satisfaction shortly after it is filed, or perhaps even before.  Mediation or arbitration may significantly speed up settlement of a case.   Rest assured that because Williams Law Group earns no fee until you make a recovery, we work efficiently and swiftly to obtain maximum compensation to our clients and bring your case to a successful conclusion.

How much money will I receive for what has happened to me?

In most jurisdictions, you are entitled to a judgment that fully compensates you for your financial loss.  If you suffered a personal injury, the defendant is responsible for paying for your medical care, both past and those expected to be incurred in the future, your past and future lost wage earnings, and an amount to compensate you for pain, suffering and the loss of your enjoyment of your life. Your spouse also might be entitled to an award. If a loved one died, the recovery usually is based on the amount of economic support and services that you lost, plus an amount designed to compensate for your grief and loss of love and affection of that loved one. We have economists who specialize in evaluating these financial injuries and calculating the lump-sum amount that will provide monetary compensation for your loss.If the conduct that caused the accident was egregious, gross, reckless or intentional  you may also be entitled to an award of punitive damages in order to punish the wrongdoer.

Do I need an injury attorney? Why not just work it out on my own? Won't I save money?

Personal injury and death cases usually involve parties who are represented by insurance adjusters and lawyers hired by insurance companies. It is also important to understand that insurers always employ the services of expert lawyers that seek to avoid responsibility or at least minimize the payments that will be made to the victims and families. In contrast, our duty is to identify all responsible parties and maximize the compensation that can be obtained. Only established firms like Williams Law Group have the staying power to investigate complex cases thoroughly, and to send a message to the defendants that they will not be able to hide their misconduct from you. Since our lawyers have experience in settling cases and know what juries and judges generally award in a similar case, we are able to advise you of the fair value of your case. Hiring an experienced personal injury attorney may best protect your rights and serve your interests.
