A confidential settlement was recently reached in favor of a 16 year old in which the small SUV he was riding became top heavy causing the driver to lose control, leave the roadway and roll over onto it's roof. The roof of the SUV crushed down onto the passengers killing two of the passengers and leaving the 16 year old severely injured. It was our argument that although the manufacturer knew or should have known that these small SUV's were top heavy and prone to rollovers, it still did not manufacture the roof support pillars strong enough to withstand a rollover.
