Can I be fired for filing for workers compensation in Tennessee?

 

A: Termination for the reporting of a work-related injury in Tennessee is illegal, unlawful, and it is very rare.

If an employee is terminated because he or she filed for workers compensation, the employer is subjected to a much larger lawsuit called "retaliatory discharge." Damages that an employee may recover in a retaliatory discharge lawsuit are; job reinstatement, past lost wages, future lost wages, any humiliation, mental anguish, and "punitive damages." 

Punitive damages are damages meant to punish the employer for the wrong act that has been done. Since punitive damages are based in part on the net worth of the employer, employers rarely want to subject themselves to the wrath of a jury for firing one of their fellow citizens.  These awards to punish the company or corporations can reach staggering amounts.  Remember the "McDonald's hot coffee case?"  That crazy verdict was to punish the corporation for wrongful acts.  So no matter how extreme that jury verdict was, it surly helps deter would be employers from firing an injured worker because the employer would be held to the same standards as was McDonald's.
