Are Changes Coming To Workers' Compensation?
Tennessee Workers Compensation Laws Entitle Employees To Medical Care For Their Injuries
Middle Tennessee Job Loses Impact Injured Workers
Your Right To Medical Care As A Tennessee Injured Worker
Q: Can I receive damages for my ‘Pain and Suffering" in my workers compensation case?
A: No. You cannot recover for your pain and suffering in your workers compensation case. Workers' compensation is a "no fault" system. This means you do not have to prove that your employer is at fault. You only have to prove that you wee injured in the course and scope of your employment. One of the areas that was given up by employees for receiving workers' compensation benefits only by proving a work related injury was the right to recover for damages due to "pain and suffering." If your work injury was caused by someone other than your employer, you can recover pain and suffering against that "third party."
