Does the Nurse Case Manager have a right to come into the Dr.'s exam room with me during my Tennessee Workers Compensation Case?

 

A:

The nurse case manager has the right to be at your Dr.'s office, but they DO NOT have the right to go into the exam room with you.   If you insist, the Nurse Case manager must remain in the lobby.

The Tennessee Department of Labor Rule 0800-2-7-.07 Case Management Information does give the Nurse Case Manager the right to make, "reasonable requests for information necessary for case management purposes."  You the employee, have the duty to "cooperate and provide information" to the Nurse Case Manager.

But NOWHERE in the rule does it say that the Nurse Case Manager has the right to go into the exam with the injured worker.
