What happens if I am injured at work, taken off work, then later released to return to work on light duty, but light duty is not available?

 

A:

If light duty is available for you before you reach maxium  medicial improvement,your employer must provide this work. This light duty work will be determined by the temporary restrictions placed on you by your treating physician.  If your employer does not have any light duty work within these temporary restrictions set by your employer, then your employer is obligated to continue paying you temporary benefits.  If you return to work on light duty and are paid less than normal because of the restrictions, then your employer must provide temporary partial disability benefits. The maximum and minimum workers' compensation rates on the date of injury will be understood and the expenses are figured at 66 2/3 % of the decrease in wages.
