A: If your request for benefits is denied then it is safe to assume that the insurance company filed a Notice of Denial with the Tennessee Department of Labor (TDOL). This means they are disputing your claim for benefits entirely or only certain parts of that claim for workers compensation. The denial is usually denying benefits for Temporary Total Benefit Payments (TTD) or Medical Treatment.
The Notice of Denial will be filed in writing immediately following their decision to deny your claim for benefits. This notice will indicate your employer's reason or reasons for denying your benefits. The reason for the denial is most often the employer claiming that your injury is pre-existing or that it did not happen as a result of your employment.
Once you receive this denial notification you may try calling or writing the insurer to resolve the issue yourself or you may file a Request for Assistance with the TDOL. If this attempt is unsuccessful, it is time to think about consulting an attorney.
