What is an Impasse that is issued a the Benefit Review Conference in Tennessee?
A: The impasse issued at a BRC effectively acts as a starting gun for the "race to the courthouse" that sometimes takes place. This race sometimes results when there are multiple courts where the lawsuit could be filed. Because either the employee or the employer can file the lawsuit after the BRC, the parties sometimes race to be the first to file suit in what they believe, for whatever reason, is the more favorable court, thereby ensuring that the case is heard in that court.
