Suing Toyota? Get in Line

Toyota has recalled over 8 million vehicles due to defective and dangerous problems with the accelerator systems. It has been admitted to by top executives that they knew of the problems months ago but continued to sell the vehicles to the public.

While cases related to injury and death are the most obvious cases that will be brought, cases under Consumer Protection Acts for damage to the value of consumers vehicles will be another type of case filed.

Given the fact that Toyota executives have readily admitted before congress while under oath that they had knowledge of the defective vehicles, and still continued to market the automobiles - this gives rise to actions under the Tennessee Consumer Protection Act.

Under the Tennessee Consumer protection Act manufactures of products that use unfair or deceptive practices while marketing their products can be held liable for three times the actual damage suffered by consumers. The sellers can also be held liable for attorney fees and litigation costs.

Toyota Deliberately Withheld Faulty Design Evidence In Crash Lawsuits

Toyota deliberately withheld vehicle design and testing evidence during lawsuits filed by consumers injured in crashes of Toyota autos.

Many consumers that purchased Toyota and Lexis vehicles that were involved in the recall may feel fortunate that these known defects have not injured them or a family member. What these consumers may not be thinking about is how much the fair market value of their vehicle has declined due to the intentional concealment of these problems.

Under the Tennessee Consumer Protection Act, if a seller or manufacturer intentionally conceals a known defect of a product, the consumer may be entitled to: 1) actual damage for the decrease in the value of their vehicle; 2) three times the actual damage as punishment to the manufacturer; 3) attorney fees and 4) the cost of litigation.

The Tennessee Medical Malpractice Claims Report for 2009 has been published by the state.

Four (yea thats 4) jury verdicts in favor of patients were reported for the entire year across this great state. Get the facts before you believe the hype from big insurance companies. Medical malpractice and lawsuits are not out of hand. Just the opposite is true.

They civil justice systems works very well. The cases that should be settled are settled and the ones where the medical provider actions did not rise to the level of medical negligence were dismissed. Medical providers won 99% of all medical malpractice jury trials in the reported year.

Tractor Trailer Wreck on I-65 Outside Nashville Claims Trucker's Life

A Tractor trailer wreck on I-65 outside of Nashville claimed a trucker's life. I-65 reopened near Bethel Road after the fatal wreck involving three semi-trailers, two cars and a pick up truck. One of the truck drivers was killed and two of the other drivers were injured.

Chrysler Issues Recall Due to Brake Failure

Chrysler, Dodge and Jeep has issued a recall that affects 24,000 vehicles that could experience a sudden brake failure.

The defective part is found on 2010 model year Chrysler Sebring and Dodge Avenger sedans; Dodge Nitro, Jeep Liberty, Jeep Commander and Grand Cherokee SUVs; and 2009 and 2010 model year Ram trucks.

Ethiopian Air Flight 409 Tumbled Out of Sky On Take Off From Lebanon

The crash of Ethiopian Airlines Flight 409 that went down off the coast of Lebanon is still being investigated. Witnesses reported that the Boeing 737 tumbled like "fire falling down from the sky" into the Mediterranean Sea.

The Boeing 737 is considered one of the safest commercial aircrafts in service today, although it has been involved in a series of incidents and crashes over the past 15 years. These crashes have been linked to problems with a valve in the rudder assembly. The valve reportedly would malfunction and cause the rudder to turn independently of the pilot's commands.

The plane was carrying 90 passengers and crew bound for the Ethiopian capital of Addis Ababa. All aboard were killed.

Tennessee Nursing Homes Rank Fifth Worst in U.S.

Tennessee's nursing homes have ranked in the bottom five for the nation for the second year in a row. Out of a rating system of one to five stars, five being the best, more than 60 percent of Tennessee's 319 nursing homes got low ratings.

There were only two Nashville area nursing homes that earned top marks in the survey.

Ethiopian Airline Flight 409 Flight Data Recorder Located

The Flight Data Recorder (also known as the "Black Box" or "FDR") of Ethiopian Airline Flight 409 that crashed off the coast of Lebanon, has been found in 1,300 meters of water in the Mediterranean Sea. The FDR has not yet been retrieved.

The plane crashed about 2 miles west of the town of Na'ameh, which is about 9 miles south of Beirut.

Four Fort Campbell soldiers died when their Black Hawk helicopter crashed during a training mission on Mount Massive in Colorado.

Investigators say that the crew's flight plan failed to take into consideration the helicopter's diminished performance limits at the 14,000 foot altitude of their training area. The investigators cited human error as the cause of the crash.

Fuji Film to Close Coffee County TN Plant

Fuji Film processing plant in Tullahoma, TN will be closing in March 2010. Over 200 Coffee County employees will lose their jobs.

The newest figures from the State of Tennessee show that in December the unemployment rate hit 10.9 percent, the highest it's been since 1983. That's 3.3 percent higher than December of last year.

Ethiopian Airlines Flight 409 Crashes on Takeoff in Lebanon

Ethiopian Airlines Flight 409 crashed of the coast of Lebanon in the Mediterranean Sea with 90 people on board.

The Government-owned Ethiopian Airlines is one of the largest in Africa.

Several African carriers are not allowed in European air space because of past safety records not being up to normal safety standards., Ethiopian Airlines serves three other continents as well as Europe for a total of 56 destinations.

The airline has experienced two fatal crashes since 1980.

Toyota Recalls 2.3M Vehicles Because of Dangerous Accelerator Pedals

Toyota is recalling 2.3 million vehicles in the U.S. to fix accelerator pedals that can become stuck, the latest in a string of quality problems that have bedeviled the Japanese automaker.

Toyota had previously blamed the problem on the pedals becoming stuck under the vehicles floor mat.

The recall affects the 2009-2010 RAV4, the 2009-2010 Corolla, the 2009-2010 Matrix, the 2005-2010 Avalon, the 2007-2010 Camry, the 2010 Highlander, the 2007-2010 Tundra and the 2008-2010 Sequoia.

Piper Crash at Memphis International on November 29, 2009 Pilot Error or Some Unknown Cause?

A pilot was fatally injured and three passengers received serious injuries when their plane crashed while landing at Memphis International Airport (MEM), Memphis, Tennessee on November 29, 2009. They were in a Piper PA-32RT-300, N9243C, which was substantially damaged during the crash.

The NTSB preliminary reports indicates that the aircraft was attempting an ILS landing on runway 18L but drifted off the localizer, left and too low for some unknown reason.

The preliminary NTSB report indicates pilot error or some unknown cause.

Nashville Construction Worker Electrocuted Working in Clarksville Tennessee

An employee of DJ Drilling and Blasting of La Vergne was electrocuted while working at a Clarksville, TN construction worksite.

The man, who was not identified, was operating a drilling rig when the equipment came in to contact with a power line that caused his death.

He was later pronounced dead at Gateway Medical Center.

A car accident in Lebanon TN on I-40 near the Beckwith Road exit claimed the life of old Brian P. Ralls, 23 of Brentwood. The crash occurred when the vehicle driven by 19-year-old Cody L. Ingram of Lebanon crossed the median on I-40, and hit two vehicles going the other direction. The driver of the first vehicle hit was John H. Ray, 48, from IL who survived the crash.

The interstate was shut down due to the three car pile up.

A Cookeville woman was killed and two men were injured in a traffic crash near Sparta, TN. Amy D. Tollison, 32, of Benton Young Road, Cookeville, died in the one-vehicle accident, says a report by State Trooper Kevin Ballew. Daniel M. Garcia, 22, of Hickey Ridge Road, Baxter, and Justin F. Tindle, 20, of Massa Road, Baxter, were injured in the crash, the report says. It happened on Wildcat Road.

Fatal Wreck Involves Children in Springfield TN

One person and several others including children were injured in a head-on collision in Robertson County outside Springfield, TN. One car side-swiped a SUV and then crashed into an oncoming van on Highway 431.

The automobile accident occurred on a bridge over Carr Creek on Sunday October 11, 2009.

It was unclear what caused the accident.

Macon County, Lafayette, TN Motor Vehicle Accident

Connie Harrison and her son, Phillip Harrison, were both air lifted to Vanderbilt Hospital during the early morning hours of September 5th, after wrecking their 1997 Dodge Caravan off of Long Creek Rd. in Lafayette, TN.

Mrs. Harrison was behind the wheel of her 1997 Dodge Caravan traveling north on Long Creek Road with her son when she lost control of the vehicle driving off the right side of the road into a culvert. The van then proceeded through a neighboring lawn where it then overturned after hitting a tree and crashed through a fence before coming to rest on the vehicle's roof in an open field. Mr. Harrison, completely ejected from the van, managed to pull his mother from the vehicle after it had caught fire. According to Deputy Michael Veatch, upon arriving at the scene Mrs. Harrison was unresponsive, while Mr. Harrison was complaining of back and neck pain. Both were air lifted to Vanderbilt Hospital.

A Vanderbilt Hospital spokesman stated that Mrs. Harrison was in the trauma unit and was listed in critical condition, while her son had been released.

Johnson Controls is cutting 343 jobs in Murray, County Tennessee due to the General Motors shutdown at the Spring Hill Plant. The shutdown is due to production of the Chevrolet Traverse being moved to Michigan in November.

Johnson Controls has given notice to the state that the layoffs will occur when the shutdown occurs.

Minivan Collision Injures Children

A minivan was struck by a pick up truck on Murfreesboro Road in South Nashville sending two adults and three children to the hospital. The minivan was attempting to turn into a church parking lot when the collision occurred. Although none of the injuries are life threatening, Metro Police Department said that the children in the minivan were not restrained properly and there was a booster seat in the back that appeared to be installed incorrectly.

A single-car accident in the Norene community of Wilson County, TN on Septembe, claimed the life of a Middle Tennessee man. The crash occurred on Cainsville Road near Simmons Bluff Road. The victim, Kenneth W. Allen, 53, of Alexandria, was the only person in the vehicle according to a spokesperson for the Tennessee Department of Safety. Allen, a Lebanon native, was transported to Vanderbilt Medical Center where he died.

Two air traffic controllers in Newark, New Jersey were suspended by the FAA following an in air collision of a small Piper Airplane and a sightseeing helicopter. . The controllers have been placed on administrative leave and disciplinary proceedings have begun.

The National Transportation Safety Board and FAA are further investigating this matter to determine the contributing factors before releasing any specific conclusions drawn from their investigation.

Aria Airlines Flight 1525 from Tehran, slid off the runway during an emergency landing killing 16 people and injuring 21. The front end of the plane was sheared off and caught fire after the hard landing at the Mashhad airport in eastern Iran.

The aircraft was another Russian made aircraft making it the second Iranian commercial airline crash in two weeks. This points to the poor state of repair of the Iranian commercial airline fleet.

A medical malpractice verdict was reached by a Shelby County, Tennessee jury is believed to be one of the largest verdicts in the state's history. The $24,000,000 judgment was to repay Courtney and Robert Hill for the damage that had been done to their lives due to the medical negligence of Dr. Claudia Moise, and her clinic, OB-GYN Specialists P.C. of Memphis.

The lawsuit was filed by the DeSoto County, Mississippi residents because the OB-GYN failed to diagnosis a lump Hall complained about over the course of 18 months. The lump turned out to be breast cancer.

Courtney Hill stated that all she hopes is that it will help physicians remember that further testing is required.

A commercial airliner has crashed killing all 168 on board. The fatal crash occurred in Northern Iran when a Russian-made Tupolevs jet flying inder the name of Caspian Airlines was heading from Tehran to the Armenian capital Yerevan.   The 168 included 153 passengers and 15 crewmembers.

Caspian Airlines is a Russian-Iranian joint venture. The venture was started in 1993.

Iran has frequent plane crashes often because of bad maintenance of its aging aircraft.   In February 2006, a Russian-made TU-154 operated by Iran Airtour, which is affiliated with Iran's national carrier, crashed during landing in Tehran, killing 29 of the 148 people on board.

It is reported 1,400 workers for the State of Tennessee will lose their jobs. Many hard working State of Tennessee workers are going to lose their jobs within the next 13 months.

On May 28, 2009 the Tennessean newspaper reported that Governor Bredesen's plan to push layoffs back until next year has collapsed. The State plans to layoff 1,400 workers in the next 13 months. A plane crashed on approach in northeast Brazil on Friday May 23, 2009, killing all 11 people on board, according to cnn.com. Among the dead were 11 adults and 4 children.The airline crash occurred near the resort town of Trancoso, Brazil. It was reported that said it was raining, but visibility was not bad.

The plane had taken off from Sao Paulo. It was also reported that there was no chance of survival at the fiery crash site.

The plane belonged to Roger Wright a prominent businessman -- who was traveling with his wife and other family members. Wright, 56, was an ex-partner of Banco Garantia and owner of Arsenal Investimentos.

Job Loses May Be Coming For Tennessee Nissan Workers

Nissan, one of Tennessee's leading automotive employers, reported a $2.4 billion annual net loss on Tuesday. Nissan has two plants in Tennessee the assembly plant in Smyrna and engine plant in Decherd. With this the first yearly loss in a decade Nissan is looking to cut 20,000 jobs. Last year, Nissan had early termination that resulted in a reduction of nearly 1,200 jobs.

Motorcycle Accident Deaths Rise in Tennessee

Motorcycle fatalities in Tennessee have increased three fold in the past 10 years. In 2008, 143 people were fatally injured in motorcycle accidents. Just 10 years earlier in 1998 the number of deaths due to motorcycle crashes was 42. In response to this 340% increase in fatal motorcycle accidents, the Tennessee Highway Patrol has launched a Share the Road campaign to remind drivers to watch out for motorcyclists.

Lebanon TN police officer Jeff Stone was killed in a motorcycle crash Saturday night. The accident happened at the intersection of Highway 231 / South Cumberland Ave. and Jennings Avenue. Stone was off duty while traveling South on US 231 on his 2006 Harley Davidson, when a 1997 BMW pulled out in front of him causing Stone to strike the BMW is the drivers door. Stone was declared dead at the scene.

Continental 3407 Crash Near Buffalo Gets NTSB Hearing

Continental Connection Flight 3407 will receive a public hearing by the NTSB on May 12-14, 2009.

The hearing will cover the safety issues concerning the crash of the Bombardier Dash 8-Q400 that occurred on February 12, 2009 near Clarence, NY. Issues covered in the hearing will include: icing effects of the plane’s performance, cold weather operations, sterile cockpit rules, crew experience, fatigue management and stall recovery management.

The purpose of the hearing is to develop facts the appropriate facts for the investigation of the worst transportation tragedy in the US in 7 years.

Questions Surrounding Responsibility For Death Of 7 Year Old School Boy In Warren County

The recent death of a 7 year old Warren County boy while crossing the road to catch his school bus raises a number of questions in the aftermath of this terrible tragedy. The bus driver has now reportedly been indicted in connection with the death, and allegedly knew her bus lights were not working. In situations like this, the question arises who will be responsible for the loss? Was it the other driver? Was it the bus driver? Was it the school system itself? And if the school system shares some responsibility, can it be liable under the Tennessee Government Tort Liability Act, which allows recovery in only certain types of situations with a limited amount that can be recovered? Even if there is a general limit under the Tennessee Government Tort Liability Act, did the school system fail to properly train its drivers or was there some policy in place that led to this accident? If so, the school system might be subject to a federal civil rights action, which would not be subject to the liability limits of the Tennessee Government Tort Liability Act. These are all questions that will be answered with time in this matter. For now, our prayers stay with the family as it tries to cope with the loss of their little boy.

Ambulance Crashes Into TDOT Dump Truck on I-24

A Coffee County ambulance crashed into a TDOT dump truck on closing I-24 for a short time.

The Saturday Independent reported, that there were multiple injuries in the accident that bottled-necked I-24 - flooding the streets of Manchester with interstate traffic. One person involved was airlifted to Centennial Medical Center in Nashville with non life threatening injuries. One of the ambulance workers involved was taken to Medical Center of Manchester.

The accident occurred near mile marker 114 and the Highway 41 South exit in Manchester, according to wkrn.com.

Victor Jones, with the Manchester Police Department said, the injured worker had just gotten up from the bench on the back passenger side when the ambulance hit the trailer and truck, peeling back its entire right side.

Robinson Helicopter's R22 and R44 models main rotor blade delaminations have become the subject of Federal Aviation Administration's (FAA) Airworthiness Directive (AD) 2007-26-12, superseding the Company's Service Bulletin.

The AD states that main rotor blade skins begin to delaminate, debond, or separate the ski near the blade tip. This delamination or debonding can occur when the bond line is exposed due to excessive erosion of the blade finish, or when corrosion occurs on the internal aluminum tip cap. Read more...

Deadly Crash Closes I-24 North of Nashville Toward Clarksville

A deadly auto crash, North of Nashville closed Interstate 24 on March 24, 2009.

The fatal wreck happened near exit 35 outside of Joelton. It involved a husband and wife from Iowa who were traveling through Tennessee in their Nissan Altima. They collided with a Chevy Trailblazer around 6:30 a.m.

News Channel 5 reports that one of the vehicles was traveling the wrong way down the interstate but at the time of the report it was not clear which vehicle was headed in the wrong direction.

The impact killed the Iowa wife and severely injured the Husband and the driver of the Trailblazer. Metro Police stated that the driver of the Trailblazer might have been drinking and driving.

The Tennessee Department of Transportation detoured West bound traffic off and around I- 24 West while the scene was cleared. Read more ...

A construction worker was seriously injured causing death by electrocution in Gladeville, Tennessee just east of Nashville.

On Monday a construction worker was killed by electrocution while working on a church expansion project in Wilson County Gladville, Tennessee which is just east of Nashville.

Although it occurred late on St Patrick's Day, investigators did not know if alcohol played a factor in the incident.

Toyota Deliberately Withheld Faulty Design Evidence In Crash Lawsuits

Toyota deliberately withheld vehicle design and testing evidence during lawsuits filed by consumers injured in crashes of Toyota autos.

Toyota chose to settle cases with injured consumers to avoid disclosing a database known as the "Book of Knowledge." The Toyota documents "show a systematic disregard for the law and routine violation of court discovery orders in product liability litigation," according to one lawmaker. Other lawmakers and federal safety regulators have accused Toyota of concealing safety problems over cases of sudden unintended acceleration of Toyota and Lexis vehicles.

Many consumers that purchased Toyota and Lexis vehicles that were involved in the recall may feel fortunate that these known defects have not injured them or a family member. What these consumers may not be thinking about is how much the fair market value of their vehicle has declined due to the intentional concealment of these problems.

Under the Tennessee Consumer Protection Act, if a seller or manufacturer intentionally conceals a known defect of a product, the consumer may be entitled to: 1) actual damage for the decrease in the value of their vehicle; 2) three times the actual damage as punishment to the manufacturer; 3) attorney fees and 4) the cost of litigation.

Suing Toyota? Get in Line

Toyota has recalled over 8 million vehicles due to defective and dangerous problems with the accelerator systems. It has been admitted to by top executives that they knew of the problems months ago but continued to sell the vehicles to the public.

Several class action lawsuits for injury and death have been filed against Toyota, the world's largest automaker.

While cases related to injury and death are the most obvious cases that will be brought, cases under Consumer Protection Acts for damage to the value of consumers vehicles will be another type of case filed. Given the fact that Toyota executives have readily admitted before congress while under oath that they had knowledge of the defective vehicles, and still continued to market the automobiles - this gives rise to actions under the Tennessee Consumer Protection Act.

Under the Tennessee Consumer protection Act manufactures of products that use unfair or deceptive practices while marketing their products can be held liable for three times the actual damage suffered by consumers. The sellers can also be held liable for attorney fees and litigation costs.

The obvious damage to consumers will be the diminution (loss or reduction) in the value of consumers Toyota vehicles. In a nutshell - anyone who purchased one of the recalled Toyota vehicles after Toyota knew of the problems but deceitfully concealed these facts - might just be entitled to three times the value they lost to their vehicle.

Tractor Trailer Wreck on I-65 Outside Nashville Claims Life

A Tractor trailer wreck on I-65 outside of Nashville claimed a trucker's life. I-65 reopened near Bethel Road after the fatal wreck involving three semi-trailers, two cars and a pick up truck. One of the truck drivers was killed and two of the other drivers were injured.

Police suspect that high winds caused the first semi-truck driver to lose control and crash causing his death. That crash caused the other vehicles to wreck.

No word of the extent of injuries to the other drivers.

Private Plane Crashes in Macon County Tennessee

Chrysler Vehicles Recalled for Due to Brake Failure

Chrysler has issued a recall that affects 24,000 vehicles that could experience a sudden brake failure.

The defective part is found on 2010 model year Chrysler Sebring and Dodge Avenger sedans; Dodge Nitro, Jeep Liberty, Jeep Commander and Grand Cherokee SUVs; and 2009 and 2010 model year Ram trucks.

The Jeep Liberties have an improperly formed brake booster rod retaining clip, and some Ram trucks may have been built without the piece. This part is essential for proper functioning of the brakes.

The problem was detected by factory workers who noticed a malformed part, and in one case a worker experienced a complete loss of brake power during testing.

Ethiopian Air Flight 409 Tumbled Out of Sky Off Coast of Lebanon

Investigators of the crash of Ethiopian Airlines Flight 409 that went down off the coast of Lebanon are still trying to determine the cause of the accident. Witnesses reported that the Boeing 737 tumbled like "fire falling down from the sky" into the Mediterranean Sea.

Terrorism and foul play were ruled out very early in the investigation, which leaves only the weather or a catastrophic failure of some crucial part of the aircraft to blame. The weather at the time the Boeing 737-800 took off was bad, consisting of driving rain, lightning and thunder. However, investigators believe that the bad weather in itself would not have been enough to bring down the jet.

A spokesperson for the Lebanese army said the aircraft was on fire shortly after takeoff. Other witnesses reported the plane broke up into three pieces.

The Boeing 737 is considered one of the safest commercial aircrafts in service today, although it has been involved in a series of incidents and crashes over the past 15 years. These crashes have been linked to problems with a valve in the rudder assembly. The valve reportedly would malfunction and cause the rudder to turn independently of the pilot's commands.

The plane was carrying 90 passengers and crew bound for the Ethiopian capital of Addis Ababa. All aboard were killed.

TN Nursing Homes Rank Fifth Worst in U.S.

Tennessee's nursing homes have ranked in the bottom five for the nation for the second year in a row. Out of a rating system of one to five stars, five being the best, more than 60 percent of Tennessee's 319 nursing homes got low ratings. Tennessee has one of the lowest staffing requirements in the country - less than half of what Medicare recommends.

While Tennessee's nursing homes fared better than a year ago in quality of care, they received deficient marks in the level of staffing.

There were only two Nashville area nursing homes that earned top marks in the survey.

Only four states had ratings worse than Tennessee. They were West Virginia, Texas, Georgia and Louisiana.

Toyota Sued for Fatal Crash in Houston

Toyota is building death traps and they know it. That is what an attorney for a Houston woman's family told reporters.

The woman's family filed a wrongful death lawsuit citing Toyota's alleged faulty accelerator pedals. This is the third such case filed in response to acceleration problems that prompted Toyota to recall millions of vehicles and halt some production.

Trina Renee Harris, a 34-year-old mother of two, died on impact when her Toyota Corolla sped through a stop sign and slammed into a cement divider wall, leaving no skid marks.

Husband Michael Harris recalled is wife telling him that the car's accelerator pedal sometimes seemed to move on its own. Harris a U.S. Navy petty officer first class had recently completed a stint on an aircraft carrier in the Middle East . He was in San Diego when he learned of his wife's death. He returned to Houston, where the family opened Christmas gifts Trina Harris had bought for them.

Other lawsuits involving similar circumstances have been filed in California and Michigan.

The Toyota Camry involved in this death was not listed among the recent recalls.

Ethiopian Airline Flight 409 Flight Data Recorder Located

The Flight Data Recorder (also known as the "Black Box" or "FDR") of Ethiopian Airline Flight 409 that crashed off the coast of Lebanon, has been found in 1,300 meters of water in the Mediterranean Sea. The FDR has not yet been retrieved.

The Boeing 737-800 was carrying eight crew members and 82 passengers when it crashed shortly after takeoff from Beirut Lebanon. The plane crashed about 2 miles west of the town of Na'ameh, which is about 9 miles south of Beirut.

The government owned Ethiopian Airlines is one of the largest carriers in Africa.

Fuji Film to Close Tullahoma Plant

Fuji Film processing plant in Tullahoma, TN will be closing in March 2010. Over 200 Coffee County employees will lose their jobs.

The plant, which has been manufacturing film since 1996, is closing due to the increased use of digital photography.

Fuji's closing comes at a time when there are already 2,500 jobless workers in Coffee Co. which has a total population of less than 25,000.
The newest figures from the State of Tennessee show that in December the unemployment rate hit 10.9 percent, the highest it's been since 1983. That's 3.3 percent higher than December of last year.

Fort Campbell Helicopter Crash in Colorado Due to Pilot Error

Four Fort Campbell soldiers died when their Black Hawk helicopter crashed during a training mission on Mount Massive in Colorado. The helicopter and crew were from the 160th Special Operations Aviation Regiment, known as the Night Stalkers.

Investigators say that the crew's flight plan failed to take into consideration the helicopter's diminished performance limits at the 14,000 foot altitude of their training area. The investigators cited human error as the cause of the crash.

The pilots, Chief Warrant Officer 4 Terrance W. Geer, 40, and Chief Warrant Officer 4 Robert M. Johnson, 41, along with crew members, Staff Sgt. Chad A. Tucker, 28, a helicopter mechanic, and Staff Sgt. Paul R. Jackson, 33, an aviation standardization noncommissioned officer, were all decorated combat veterans with 10 to 20 deployments each.

An Army spokeswoman said that the unit has already updated its procedures to include more specific altitude information in their flight plans. Night Stalkers often must fly in extreme conditions, including high-altitude takeoffs and landings, and they train in Colorado and elsewhere to get accustomed to those conditions.

Toyota Suspends Sales of Vehicles With Defective Accelerators

Toyota has suspended sales of eight vehicle models that were involved in the accelerator pedal recall. The models include: 2009-2010 RAV4, 2009-2010 Corolla, 2009-2010 Matrix, 2005-2010 Avalon, Certain 2007-2010 Camry,2010 Highlander, 2007-2010 Tundra, and the 2008-2010 Sequoia.

The recall and suspension of sale affects approximately 2.3 million vehicles that are equipped with the mechanism in question, which can cause the accelerator pedal to become stuck in the depressed position.

This recall and suspension of sale is separate from the on-going recall of Toyota and Lexus vehicles to reduce the risk of pedal entrapment by the floor mats. Approximately 1.7 million vehicles will be subject to both separate recall actions.

These defective and dangerous accelerator pedals have caused a number of deaths across Tennessee and across the Country.

Ethiopian Airlines Flight 409 Crashes on Takeoff in Lebanon

Ethiopian Airlines Flight 409 crashed of the coast of Lebanon in the Mediterranean Sea with 90 people on board.

The flight, which originated from the Rafik Hariri International Airport in Beirut, Lebanon, was headed for the Ethiopian capital city of Addis Ababa when it disappeared from radar shortly after takeoff.

The Boeing 737-800 had seven crew members and 82 passengers -- 51 Lebanese nationals, 23 Ethiopians, two Britons and citizens from Iraq, Turkey, Syria, Canada, Russia and France.

Lebanese authorities did not immediately know the cause of the crash but also do not suspect any foul play.

The Government-owned Ethiopian Airlines is one of the largest in Africa. Several African carriers are not allowed in European air space because of past safety records not being up to normal safety standards., Ethiopian Airlines serves three other continents as well as Europe for a total of 56 destinations.

The airline has experienced two fatal crashes since 1980.

Toyota Recalls 2.3M Vehicles to Correct Sticking Accelerator Pedals

Toyota said Thursday it is recalling 2.3 million vehicles in the U.S. to fix accelerator pedals that can become stuck, the latest in a string of quality problems that have bedeviled the Japanese automaker.

Toyota has issued a recall on some of its vehicles due to a problem with an accelerator mechanism that can cause the pedal to become stuck, causing uncontrollable acceleration. Toyota had previously blamed the problem on the pedals becoming stuck under the vehicles floor mat.

This problem has been labeled the cause of several crashes, including the death of four people in San Diego that were riding in a Lexus that accelerated to more than 120 mph before crashing.

The recall affects the 2009-2010 RAV4, the 2009-2010 Corolla, the 2009-2010 Matrix, the 2005-2010 Avalon, the 2007-2010 Camry, the 2010 Highlander, the 2007-2010 Tundra and the 2008-2010 Sequoia.

A total of 1.7 million vehicles contain the gas pedal system that is manufactured by a single supplier for Toyota.

I-440 East On-Ramp in Nashville is More Dangerous Than Ever

The steep curve at the I-440 on ramp from 40 eastbound in Davidson Co. has seen a sharp increase in accidents in the past five years.

The Metro police department and Tennessee Highway patrol have worked a total of 121 accidents on the curve in the past five years, 28 of which resulted in serious injuries. These numbers are 10 times higher than five years ago.

In an effort to curb the accidents TDOT has begun an experimental texturing project that should give vehicles more traction. It used a machine to give the surface of the road more texture, but TDOT wasn't satisfied, so it now has a new plan. TDOT is going to try a different method of the road grinding. "This machine will grind up the surface of the roadway and give us some texture and hopefully help with people skidding on that surface," said a spokesman for TDOT. The TDOT spokesman also stated that the angle of the curve at 40/440 is not a flawed design, but insisted that people should obey the 45 miles per hour speed limit.

Nashville Ambulance Driver Suffered Medical Crisis Before Fatal Wreck

The Nashville ambulance crash, that killed paramedic driving the ambulance and the 78 year old passenger Sue Bly , may have been caused by the preexisting medical conditions of the driver.

The ambulance driver, David Cline, had a history of vehicle accidents caused by seizures and a condition called narcolepsy which causes a person to fall asleep uncontrollably at any given time. Cline was also sending text messages before the crash but investigators do not think Cline was texting at the moment of impact because the phone was found on his body not among the debris scattered around the wreck site.

The fatal accident occurred when the ambulance drifted off the road and struck a TDOT vehicle at more that 50-mph without ever hitting the brakes.

Cline had his license suspended 10 years ago, after an accident on Christmas Day when he had a seizure and struck a light pole. His license was reinstated a few months later, after his doctor filled out paperwork saying he was fit for driving, according to the report. Cline, who also worked as a firefighter in Franklin, had a seizure on that job several years ago.

Nashville Construction Worker Electrocuted Working in Clarksville Tenn

An employee of DJ Drilling and Blasting of La Vergne was electrocuted while working at a Clarksville, TN construction worksite.

The man, who was not identified, was operating a drilling rig when the equipment came in to contact with a power line that caused his death.

He was later pronounced dead at Gateway Medical Center.

Nashville Metro Officer Injured in Wreck

Nashville Metro police department officer Frank Campbell was injured while assisting motorists who had run off the road near the I-440 East ramp at I-40 East.
Mauray Santulli, lost control of his pickup and collided with Officer Campbell's squad car which was parked on the side of the road. Luckily neither the Officer nor Santulli's injuries were life-threatening.
An investigation is continuing into whether any charges will be placed.

FAA Watching American Airlines Closely After Botched Landings

The FAA has heightened its scrutiny of American Airlines after three incidents involving the carrier between December 13 and December 24.
The review was begun after the December 24 landing of an MD-80 in Austin, Texas, wherein the plane struck a wingtip.
On December 22 a Boeing 737 overran the runway in Kingston, Jamaica and injured 91 passengers.
Another incident on December 13 involved an MD-80 that went off the left side of the runway at the Charlotte Douglas International Airport in North Carolina.
A spokesman for the FAA stated that the agency is using the review of these incidents to determine if they were caused by a "larger issue."

American Airlines Flight 331 Crashes in Jamaica

American Airlines flight 331 left the runway in Kingston, Jamaica, crashing through a sand bank stopping a few feet from the Caribbean Ocean.

The Boeing 737 aircraft with 156 people on board originated in Washington, D.C., stopped in Miami before attempting to land in heavy rain and turbulence at Norman Manley International Airport in Jamaica.

The aircraft broke into 3 pieces and the landing gear on one side of the plane appeared to have collapsed. Reports indicate that dozens were injured.

Lebanon TN Man Dies in School Bus Wreck

A Lebanon TN man was killed in a crash involving a school bus and the deceased's truck. The collision occurred on Highway 109 near Bates Road in Wilson County. The bus had stopped to let children off when the pickup hit the school bus from behind.

A spokes person for the THP stated that the driver of the truck was Phillip Houston of Lebanon. There was also a minor female passenger riding in the truck. She was transported to UMC with non life threatening injuries.

There were four elementary school children on the school bus at the time of the wreck but none of the children were injured.

THP and Wilson County Emergency Management are investigating the accident.

Tennessee Roadways See Fewer Deaths in 2009

Deaths on Tennessee roadways are dow according to the Tennessee Highway patrol. The THP attributes stricter laws to the drop in roadway fatalities since 2005.

October of 2008 saw 805 fatalities where 2009 has seen 707 deaths thus far in 2009. Officials say the drop is due in large part to people paying more attention to the law. The THP has achieved this through grants that have allowed officers to step up enforcement of DUI, aggressive driving , texting and seatbelt laws. The heavier enforcement has forced people to pay more attention to their driving.

Lycoming Engines is a Pennsylvania company, Robinson Helicopter Company is located in California, and AVCO and Textron are both Delaware corporations.

Child in Car Safety Seat Survives Murfreesboro TN Bus Crash

A child survived a collision of a car and a school bus because she was secured in a child car safety seat. The crash occurred in Murfreesboro TN near Riverdale High School, in Rutherford County. The driver of the vehicle was killed when her vehicle collided with the school bus.

Police said Jessica Moss crossed the center line and hit the bus, driven by Acie Lawrence, head-on. Moss had to be extricated from the vehicle and died a short time later. The baby who was in the back seat at the time of the accident is now with relatives.

Baby Seriously Injured By Wrong Car Seat

A Cookeville woman and her two year old child were seriously injured in a car accident on highway 136 in Putnam County, TN. The child's booster car safety seat was not was not appropriate for his age which caused him to be ejected through one of the car windows during the crash. A second child was in the vehicle in an appropriate car seat and was not seriously injured according to a spokesman for the Tennessee Highway Patrol.
The automobile accident occurred on October 26^th, 2009 just north of Village Road on highway 136 outside of Cookeville. Kimberly Lynn Johnson of Spruce Avenue, Cookeville, was driving a 1994 Toyota Corolla and her sister, Ashley Nicole Garcia was riding in the front passenger seat. Garcia's two children, Monica Nicole Garcia, 17 months, and Alex Alonzo Garcia, 2, were in the back seat.

The driver lost control of the car causing it to run off the right side of the road where it then began flipping as many as three times. The two year old child that was ejected landed in the northbound lane of the highway.

A life flight medical emergency helicopter flew the child to Erlanger Hospital in Chattanooga.

Delta Flight Lands on Taxiway Instead of Runway in Atlanta

Delta Airline's flight 60, from Rio de Janeiro, Brazil, to Atlanta's Hartsfield-Jackson International Airport landed was cleared to land on Runway 27R but landed instead on Taxiway M, which runs parallel to the runway. The flight had 194 passengers and crew on board.

Thankfully no other aircraft were on the taxiway when the Boeing 767 made the taxiway landing. A collision, particularly with one plane preparing to take off and carrying a full fuel load, would be catastrophic.

Both 27R and Taxiway M are 11,890 feet long but the runway is marked with white lights while the taxiway is marked with blue lights.

The pilots of the plane that landed at the Atlanta airport have been relieved from flying duties pending investigation by the FAA and the NTSB. Delta announced that it was as conducting an internal investigation.

Macon County Head On Collision Critical Injures Portland Woman

A Portland, TN woman was critically injured in a head on collision on Highway 10, just outside of Lafayette, TN. Jennifer Gilliam, of Sumner County was traveling South down the Highway 10 hill while Calvin Johnson Jr. of Macon County, TN was traveling North up the well known hill. The two vehicles crashed head on into each other.

The responding officers were of the opinion that Gilliam lost control and crossed over the line striking the vehicle driven by Johnson. The responding officer stated that upon arrival to the scene he "found the driver of the flatbed outside of his truck, but the young woman in the Explorer was unresponsive and her vehicle was on fire." Gilliam was transported to Macon General Hospital and then to Vanderbilt Medical Center in Nashville. The condition and injuries of Johnson was unknown.

Highway 10 was closed from the Lafayette City limits to Fergusson Hill Road for clean up of the accident.

Peterbilt Madison Plant Closes 390 Jobs Lost

The Peterbilt truck plant in Madison will close permanently as of Dec. 1, 2009, taking with it 390 jobs of United Auto Workers union Local 1832.

A spokesperson for Peterbilt Corp said it would consolidate production at its other plant in Denton, Texas. Texas plant is nonunion. The The Madison plant has been in operation 40 years. Several of the workers losing their jobs have been there for those 40 years.

The workers were locked out in June of 2008, when the United Auto Workers union Local 1832, which represents the hourly workers, declined to call a vote on a contract offer presented to the union. Sales of big trucks have declined about 70 percent in the past year. Peterbilt says it just makes financial sense to consolidate the plants.

Peterbilt is a subsidiary of PACCAR Inc., which also makes Kenworth trucks.

A MH-60 Blackhawk Helicopter crashed in Colorado killing four Fort Campbell-based Delta Company, 1st Battalion, 160^th Special Operations Aviation Regiment members. The soldiers were killed while conducting mountain and environmental training near Mount Massive. Those killed in Wednesday's crash were Chief Warrant Officers 4 Terrance Geer, 40, of Casper, Wyo.; and Robert Johnson, 41, of Seattle; and Staff Sargents Paul Jackson, 33, of Lancaster, Md., and Chad Tucker, 28, of Titusville, Fla.

The "Night Stalkers", as they were known, was created more than 20 years ago after a failed mission to rescue hostages in Iran, which resulted in two helicopter crashes and eight deaths. This regiment's primary purpose is to get Special Forces soldiers, Army Rangers and Navy SEALS into some of the most dangerous areas in the world for covert operations using the cover of nightfall and keeping low to the ground to avoid radar detection.

Currently the regiment has four battalions, two based at Fort Campbell, one at Hunter Army Airfield, Ga., and one at Fort Lewis, Wash. They use a variety of helicopters including Black Hawks, Chinooks and AH-6 Little Birds. The unit has played a large role in Iraq and Afghanistan, suffering several casualties in 2005 and 2007.

School Bus Accident Injures 21 Children Near Winchester TN

A school bus carrying 21 Franklin County High School, South Middle School and Cowan Elementary School students veered off the road and then flipped into a field. All 21 aboard were taken to Southern Tennessee Medical Center in Winchester and treated for minor injuries.

Parents of the students stated that they have been concerned for their children's safety for the past year since Ms. Daythene Morris took over the route. Some of the concerned parents eventually took their children off the bus because they were afraid of the possibility of a serious wreck or injuries

School officials stated that a bus accident involving injuries has not occurred in the Franklin County School District in several years.

Fortunately, there were no other vehicles involved, but the accident will remain under investigation.

Construction Contractor's Failure to Warn Traffic of Backup Causes Death

The failure of a construction company to properly warn oncoming traffic and give them sufficient notice of upcoming construction delays caused the death of a man which swerved off the roadway to miss the backed up traffic.

The widow and children of Richard Kunzler were awarded nearly $4.4 million in damages by a Utah Court after he suffered fatal injuries in 2006 when he attempted to avoid backed up traffic on Interstate 15, resulting in his car striking other vehicles.

The lawsuit claimed that the Utah Department of Transportation (DOT) and subcontractors failed to give sufficient notice about the traffic back up for motorist approaching the bridge construction near Spanish Fork. Kunzler, 38, knew there was construction but was unaware of the traffic delay according Tyler Young, the attorney who represents the family. He said Kunzler topped the hill when the driver directly in front of him slammed on his brakes to avoid rear-ending the stand still traffic consequently causing Kunzler to swerve and crash. Only 13 days later, Kunzler died from those injuries sustained.

Jurors determined damages totaling $4,396,268. Almost $2 million was deducted because of a state law that caps damages against the state and for the victim's partial responsibility in the incident. The final award totaled $2,896,268 for pecuniary damages and $375,000 a piece for his widow and each of his children for loss of care, comfort and companionship. Responsibility was distributed as follows: 20 percent to the victim for part of the negligence that caused his death, 35 percent to UDOT and 45 percent to the subcontractor, Staker & Parson Cos.

Minivan Collision Injures Children

A minivan was struck by a pick up truck on Murfreesboro Road in South Nashville sending two adults and three children to the hospital. The minivan was attempting to turn into a church parking lot when the collision occurred. Although none of the injuries are life threatening, Metro Police Department said that the children in the minivan were not restrained properly and there was a booster seat in the back that appeared to be installed incorrectly.

Tractor Trailer Merges into Car Killing TX Man in Nashville Crash

Fleetguard Jobs Moving From Cookeville TN to Mexico

Fleetguard officials announced that 140 employees will lose their jobs due to three filter assembly lines being moved from the Cookeville facility to Mexico. The jobs will be lost beginning in mid-November and lasting through mid-January.

Fleetguard, a subsidiary of Cummins Filtration is keeping silent as to the issues of severance packages and whether more job losses will follow. Cookeville's Fleetguard plant currently employs around 700 people.

Cheatam County TN Employer Laying Off Hundreds

Trinity Marine Products will lay off 327 workers in October of 2009. The company is one of Cheatham County's largest employers. It is located on the banks of the Cumberland River in Ashland City, TN.

The company is blaming a downturn in orders for its barges.

Highway 231 Head On Collision Near Lebanon TN Results in Death

William Clarence Norris. Norris, 49, was riding in the passenger seat of a 1985 Ford F-150 pick-up truck driven by L.D. Bell, 71, when a tanker truck driven by Michael J. Bradley crossed the center line, hitting them head-on which resulted in the death of Norris. The collision occurred north of Lebanon, Tennessee on Highway 231.

The Tennessee Highway Patrol reported that a bus had stopped to drop off children and the driver of the tanker truck was unable to stop. Bradley, heading Northbound on 231, swerved into southbound traffic striking Bell and Norris head on launching them 50 feet back onto the roof of the truck. All parties involved were wearing seatbelts except Bell, who only suffered minor injuries.

Bradley was cited with multiple misdemeanors including failure to maintain due care, driving left of center and reckless driving.

Trucker Crushed By Silage Family Files Lawsuit

A trucker which was crushed to death by silage falling on his truck is the subject of a lawsuit filed in Iowa and OSHA (Occupational Safety and Health Administration) has fined the responsible dairy $1700 in fines for safety violations.

The lawsuit was filed against 4-Bros Dairy by the widow and father of Chad Thompson, 30, who was killed March 7, 2008, when a 40 foot pile of silage fell on top of the Simi he was driving. The surviving family contends that the owners of 4-Bros Dairy were negligent in maintaining the pile and by directing Thompson to the location without warning him of the dangerous conditions.

4-Bros Dairy did make a statement regarding previous warnings that had been issued to Thompson for parking too close to the pile.

Hudson River Crash Results In FAA Suspending Two Air Traffic Controllers

Two air traffic controllers in Newark, New Jersey were suspended by the FAA following an in air collision of a small Piper Airplane containing pilot Steven Altman, his brother Daniel and Daniel Altman's son Douglas and a sightseeing helicopter carrying five Italian tourists and a pilot. The controllers have been placed on administrative leave and disciplinary proceedings have begun.

While flying over the Hudson River the pilot of the Piper Airplane, Steven Altman, was electronically cleared and transferred to the Newark, New Jersey's air traffic controllers at Teterboro Airport. Immediately following this transfer, Newark's control tower was to be given the standard verbal confirmation from Altman, but never received.

Thus far, only statements have been made in regards to the conduct of the air traffic controller and the tower supervisor being absent at the time when the two aircraft suddenly collided but nothing has yet to be definitely determined pending further investigation. At this time, no certain actions have been contributed to the cause of the accident.

The National Transportation Safety Board and FAA are further investigating this matter to determine the contributing factors before releasing any specific conclusions drawn from their investigation.

Portland's Albany International Plant to Close

Albany International Corp. announced that it is closing its Portland, TN plant. The fabric plant closing will leave 156 Tennessee workers without a job. A final shutdown expected by June 30, 2010. Most of the employees will be laid off beginning in September and some will remain until the plant closes completely in the summer of 2010.

The work that is being done at the Sumner, County TN facility will be immediately be transferred to Wisconsin and Canadian facilities. The fabric from the Portland plant is used to create forms that paper machines make into all types of paper products. A spokesperson for Albany International stated the paper industry has been consolidating, which has cut the demand for the fabric.

Fatal Crash on Highway 11 Claims LIfe of Bradley County Tennessee Man

Charges of vehicular homicide are reportedly pending against Mr. Bohannon.

Southwest flight 2294 was traveling from Nashville, TN to Baltimore, MD when the passengers were forced to experience a life-changing event. The Boeing 737-300 made an emergence landing in Charleston, WV after an explosive and sudden decompression of the cabin while at 34,000 feet. This sudden cabin decompression was caused when the fuselage ripped open forming a 17 inch hole near the rear of the airplane.

Latest Iranian Plane Crash Kills16 – Injures 21

Another Russian-made airliner, Aria Airlines flight 1525, skidded off the runway in Mashhad, Iran and caught fire as it made a hard landing. Sixteen people were killed in this Iranian commercial plane crash. Twenty One passengers were injured in the crash.

It was the nation's second deadly plane accident in two weeks. Caspian Flight 7908 crashed less than two weeks prior near Qazvin in North Eastern Iran, claiming 168 lives.

A photo of the latest crashed airplane which was released by the state run news media showed the nose of the aircraft sheered off. A spokesperson for the Iranian Civil Aviation Organization, stated that the plane struck a wall after skidding off the runway.

It was further reported that the tires of the Ilyushin-62 may have failed upon landing.

Iranian Caspian Flight 7908 – Williams Law Group Retained by Surviving Family

Plane Crash Takes the Life of Mt. Juliet TN Man

James Michael Bowers, 46, of Mt. Juliet , TN was flying a single engine airplane from Tennessee to Wisconsin when it crashed in Wabash County, IL.

Bowers was solo piloting a 1941 Luscombe vintage single-engine airplane to an experimental aircraft show in Oshkosh, WI. He was the only person on board and died upon impact.

An autopsy of Bowers did not reveal any health problems. The FAA will investigate whether a mechanical problem, faulty maintenance or pilot error caused the fatal crash.

It was reported that Mr. Bowers worked for the Nashville Electric Service and was working toward a career as an electrical engineer. He leaves behind a wife and stepdaughter.

Iranian Plane Crash Black Boxes Recovered

Caspian Airlines' flight 7908 "black boxes" have been recovered. The Russian made, Tupolev 154M jet crashed 16 minutes after takeoff in northern Iran while in route to Armenia. All 168 aboard were killed.

The so called "black boxes" include the aircraft's cockpit voice recorder (CVR) and the flight data recorders (FDR). The CVR and the FDRs will be key in determining the cause of the crash which remains unknown. CVRs and the FRDs are built to survive crashes and intense fires such as this one. They record a plane's performance, such as air speed and altitude, as well as communications between the cockpit crew and with air traffic controllers on the ground.

Witnesses reported that the tail of the jet seemed to be on fire. The engines of the Tu-154M are located in the rear of the airplane. Other reports said that it appeared that the pilot was circling with the landing gear dow in search of a place to make an emergency landing. The commercial jet crashed nose first, plowing a long trench into fields outside the village of Jannat Abad, in northwestern Iran.

A team of Russian air accidents experts are investigating the crash.

The crash of Caspian Airlines' flight 7908, is included in a string of air disasters in recent years that have indicated Iran's problems maintaining it's aging fleet of commercial aircraft. Iranian airlines include private and state run airlines. Both are chronically strapped for cash and in turn, the fleet's maintenance has suffered as a result.

The United States has imposed sanctions on Iran that prevents the airlines from updating their 30 plus year old American aircraft. Instead Iranian airlines have come to rely upon Russian aircraft. Many of these planes date back to the Soviet-era and parts are diddicult to find due to the Soviet Union's demise.

It was reported that the Tu-154M that crashed was built in 1987 and was bought by Iran in 1998. It was also reported to have an "overhaul certificate" valid until 2010. "Overhaul Certificate" is not a term used by American and most European aviation experts. It is not clear at this time exactly what the maintenance records of the aircraft will show.

The crash is Iran's worst since February 2003, when a Russian-made Ilyushin 76 carrying members of the elite Revolutionary Guards crashed in the mountains of southeastern Iran. That crash killed all 302 people aboard. That crash was a sign of how maintenance problems have persisted with the Iranian airlines.

Wrong Way Driver Crashes On I-24 Outside Nashville

A wrong way driver reportedly crashed into tractor-trailer on Interstate 24 in Robertson County Tennessee on Tuesday, July 14, 2009. The accident occurred Tuesday evening and closed all eastbound lanes on I-24. One person was reportedly taken to Vanderbilt.

Nashville Flight Makes Emergency Landing

A commercial airline flight from Nashville, TN was forced to make an emergency landing after the cabin suddenly depressurized, deploying cabin oxygen masks. The Southwest Airlines, Boeing 737 was in route from Nashville to Baltimore and made the emergency landing in Charleston, WV after a football-sized hole formed in the rear of the fuselage forward of the vertical stabilizer. There were no injuries.

The NTSB and the FAA are investigating the cause of the incident.

The damaged jet will remain on the ground in West Virginia until federal inspectors can finish their examination. In addition to this inspection, all 181 of Southwest's 737-300s -- about a third of the airline's fleet -- will be inspected overnight due to the emergency landing after departing Nashville.

This incident brings us to mind of the 1988 Aloha Airlines flight in Hawaii, where another Boeing 737's top fuselage structure failed. That failure was determined to be caused by unstable crack propagation due to improper maintenance on a bonded area of the skin of the fuselage. In the Aloha Air incident, a passenger noticed the crack when boarding but failed to report it to the crew.

Fatal Motorcycle Accident on Highway 70 Claims Life Of Woman Near Tennessee City

A 17 year old boy reportedly died on July 4, 2009 after a car wreck that occurred in Smyrna, Tennessee. • Start early. Pediatrician Tanya Remer Altmann (author of Mommy Calls (American Academy of Pediatrics; $12.95)) gave her two preschoolers helmets as soon as they started riding toys in the driveway. Altmann who practices in L.A. said, "They need to know they can't ride around on wheels without a helmet on their heads."

• Stay firm. Some children start refusing car seats the first time they are put in one. If you give in once, to that stubborn toddler or to a small 10-year-old who still needs a booster, your child knows that you will give in the next time. It also may be the day you get in a crash. Make sure your child's safety is non-negotiable.

• Engage the kids. Let them know the rules. Let them know what to expect as far as the physical milestones they'll need to pass before moving from a car seat to a booster or a booster to an adult belt. (See details at usa.safekids.org)

• Get help. Establish a neighborhood bike-helmet watch and let the kids know that any adult who sees them without protective gear will give you a call.

Child Killed in Interstate 40 Crash Near Monterey, TN

An 8-month-old baby was killed and two adults were injured in an auto accident on I - 40 near Monterey, Tennessee. The infant was properly restrained in a child seat, and the seat was properly installed according to a spokes person for the Tennessee Highway patrol. Another infant in the same vehicle was not injured.

The collision occurred when an SUV being driven by Adrian Castro Huerta of Vinita, OK was traveling west hit a wheel which had come off a vehicle that was being driven in the eastbound lane by Matthew Presley of Cookeville, TN.

Presley's left front wheel came off his 1992 Ford F150 pick-up and crossed the median into the oncoming vehicle in the westbound lane. Huerta's vehicle collided with the lose wheel and tire causing him to lose control of his vehicle. The vehicle rolled over several times killing the infant in the process.

Presley, the driver of the truck which lost it's wheel, was not injured.

The report did not indicate why the wheel came off or who last put the wheel and tire on Presley's Truck.

Tennessee Teen Driving Deaths Ranks 6th in the Nation

A recent study revealed that Tennessee remains one of the deadliest states for Teenage drivers. According to the study conducted by Allstate Insurance Company, Tennessee ranked sixth in the nation for driving deaths of teens. The Nashville, TN region was was ranked fourth among 50 metropolitan areas.

The study cited speeding and failure to wear seatbelts as the most common problems. Safety officials and other researchers have said that the lack of mandatory driver training, failure to wear seat belts and texting while driving also contribute to the problem. All of these factors coupled with the fact of Tennessee's narrow and winding roadways also contribute to teenage driving deaths.

Allstate's report says, that when a teen is killed in an automobile crash, the driver is a boy more than two-thirds of the time. The teenagers in the highest risk group are young men, African-American males, students with lower grades and students who drink and drive.

Tennessee driving fatalities have been down the past two years. Teen drivers were involved in 10 fatal crashes in the state as of June 12, 2009 as compared to 72 in all of 2008.

Last year, 1,033 Tennesseans of all ages were killed in traffic accidents.

Zicam Users Get Warning From FDA

The Food and Drug Administration warned consumers to stop using Zicam Cold Remedy and Zicam Cold Remedy Swabs a popular homeopathic cold remedy, because they could cause anosmia and damage or destroy their sense of smell.

The FDA received over 130 reports from consumers and healthcare providers of people losing their sense of smell after using Zicam.

The nasal products were first introduced in 1999 by Matrixx Initiatives of Scottsdale, AZ. In 2006, Mattrix paid $12 million to settle 340 lawsuits filed by Zicam users who lost their sense of smell from the use of the product.

After the federal agency issued the consumer warning, the drug manufacturer refused to recall the products. Matrixx did suspended further shipments of the dangerous products and said they would reimburse customers who wanted a refund.

The F.D.A. does not have the power to order product recalls but must rely on manufacturers to do so voluntarily. Bills now moving through Congress would give the agency the power to order the recall of products which place American consumers in danger.

The F.D.A. warning letter sent to Matrixx on Tuesday states that Zicam Cold Remedy intranasal products "may pose a serious risk to consumers who use them" and are "misbranded." Such language would normally describe a recall alert. The products have no proven benefits.

In actuality since the hype of the report, little or nothing has been done to reform the short comings nor have any of the key reforms recommended in the report been implemented according to Consumers Union (CU). CU is the nonprofit publisher of Consumer Reports.

A new report was just issued, ‘To Err is Human - To Delay is Deadly" CU gives details of the lack of action since the earlier report ten years ago. The IOM estimates that as many as 98,000 Americans die each year as the result of preventable medical errors. This new report was released just as congress and the Obama administration are working on legislation to address the rising cost of healthcare in the U.S. CU argues that reducing medical harm such as hospital acquired infections would not only improve patient care but also provide a significant cost reduction which could be used to expand healthcare coverage to those families not now covered.

A spokes person for CU stated that, "There is little evidence to suggest that the number of people dying from medical harm has dropped since the IMO first warned about these deadly mistakes almost a decade ago." During those ten years, a million American lives have been lost due to medical errors. There has also been billions of dollars wasted because our healthcare system failed to adopt key reforms recommended by the IOM. These key reforms will protect patients and reduce healthcare costs. As the debate over health care heats up in Washington, Congress should make sure that improving patient safety is a central part of any reform legislation it adopts.

The 1999 report estimated that medical errors cost the U.S. $17 - 29 billion every year. It recommended sweeping changes to the healthcare system in order to improve patient safety. The report called for a 50 percent reduction in medical errors over a five year period. None of the suggested bills were adopted by congress and there has been no reduction in the number of people harmed and killed by medical errors in the last ten years.

"One decade later, we can't say whether we are any better off today than when the IOM first sounded the alarm about medical errors in 1999," said Arthur Levin, Director of the Center for Medical Consumers and member of the IOM's Committee on the Quality of Health Care in America, which issued the landmark To Err is Human report. "We can't wait another decade to take the steps needed to protect patients from deadly and costly medical errors. The time to act is now. Too many lives and health care dollars are at stake." Levin assisted Consumers Union with its report.

There is little evidence that physicians, nurses, and other health care providers are any more competent in patient safety practices than ten years ago.

Cessna Airworthiness Directive issued by FAA 150s & 152s

The FAA has issued an airworthiness directive (AD) for all Cessna 150 and 152s. This AD affects some 17,000 Cessnas and was first proposed in 2007. The AD requires owners and operators to either install a placard in the aircraft which prohibits spins ansd other aerobatic maneuvers, or to replace some of the rudder parts. These alterations to the airplane costs owners and operators about $500.00.

AOPA opposes this AD. The aircraft owners association recommended that the FAA issue a special information bulletin for a one-time inspection of the rudder of the affected airplanes.

The AD stems from two separate fatal crashes in a Cessna 150 and a Cessna 152 in which pilots were practicing spins and were unable to recover control of the aircraft.

AOPA claimed that the aircraft in one of the fatal crashes was not airworthy and should have not been flying. It was alleged that the second fatal crash was caused by improper installation of the Cessna's rudder bumpers. AOPA's president said that they were working with the FAA to try to mitigate the impact of the AD and has contacted the FAA's small airplane directorate to see why such a sweeping action was deemed necessary. The Cessna Pilots Association (CPA) has voiced concerns over the AD being issued.

The FAA reasoned the AD was necessary because Cessna Inc. demonstrated that there could be contact between the rudder and elevator even when the aircraft met type design and Cessna felt the kit installation resolved that issue.   Cessna owners and operators must comply with the AD within 100 hours of operation of the affected aircraft after a June 17, 2009 deadline, or within 12 months of the date - which ever is first.

Plane Crash Near Knoxville KIlls Two

A plane crash near Knoxville, Tn claimed the lives of two Tennessee men over the weekend. Bret Smith, 40, of Pleasantville, Tenn., the pilot, and Ron Siedentoph, 54, of Lake Way Drive in West Knox County, were killed when the small sea plane crashed into Melton Hill Lake.

It is unclear from the FAA records of the type of aircraft. One report by knoxnews.com it as a "Searey" fixed-wing, experimental craft built in 2001, while wbir.com claims the FAA records reveal that it was a fixed-wing single-engine SeaRay modified Piper Cherokee.

The single engine plane which carried two passengers crashed into the lake while attempting a landing on the water.

A witness described the moments before the crash as, "... the plane was flying very low before it nose-dived and hit the water. It had been circling and we thought it was going to hit the trees, then it went straight down and we heard the sound, like a big slam on the water." Other witnesses said that they saw the plane bank sharply and then hit the water at a steep 45-degree angle.

It was reported that he Siedentoph family was hosting a gathering in honor of a son's upcoming wedding.

Dangers of Treadmills

The death of Mike Tyson's 4-year-old daughter Exodus, highlighted the dangers of treadmills and other home exercise equipment. The child was found with a treadmill cord around her neck while her mother was cleaning in the next room according to nytimes.com.

Doctors and emergency rooms around the United States are reporting a growing number of severe burns on the hands and fingers of young children due to treadmills. These injuries occur when the child, toddler or infant touch the treadmill belt while it is running. Although some injuries happen while the child is un supervised, many of these preventable accidents occur when children approach from behind as a parent is using the equipment. The curious little hands reach in and touch the moving belt or reach under the machine where even more moving parts exist. These belts and other mechanical moving parts can cause children to suffer excruciating burns that can require multiple skin grafts and cause permanent disability.

An Australian study found that treadmill friction injuries accounted for about 1 percent of pediatric burns, but concluded that the incidence of these injuries is on the rise. The Australian government launched a campaign called, "Treadmills and Kids Don't Mix" in an attempt to warn parents of the dangers of treadmills and other home exercise equipment. This summer a new safety standard will take effect requiring all manufactures to have a prominent warning label instructing parents to keep children away from the dangerous machines while they are in use.

It is well advised for parents to keep treadmills and other exercise equipment lacked and unplugged so children can not start these dangerous products. It is also a good idea to position the equipment so that parents will have a clear view of the room where the exercise equipment is located. This will allow parents to observe approaching children.

Pulmonary Embolism and Deep Venous Thrombosis - Diagnosis and Treatment

Diagnosis of Acute PE

The mortality rate is 30 percent when pulmonary embolism goes untreated. These deaths are largely the result of a recurrent embolism. The symptoms and signs of PE are relatively nonspecific. These symptons include but are not limited to dyspnea, pleuritic pain, cough, hemoptysis, tachypnea, and tachycardia. Less than one-third of patients have symptoms or signs of DVT.

Treatment of DVT

Recurrent PE within the first few hours is the cause of most PE deaths. If there is a clinical suspicion or a actual diagnosis of PE, anticoagulant therapy should be promptly initiated. This treatment should be with subcutaneous low molecular weight (LMW) heparin or intravenous unfractionated heparin. The goal of this treatment should be to achieve a therapeutic level within the first 24 hours. After this initial treatment, heparin should be continued for at least five days. The heparin can be discontinued on day five or six if the internationalized normalized ratio (INR) has been therapeutic for two consecutive days.

Hospital medical staff protocols for the treatment of VTE should be followed in addition to the above procedures.

Fatal Crash Stewart County Tennessee Two Die

Two men were reportedly killed in a fatal two car accident on U.S. Highway 79 east of Dover, Tennessee on May 21, 2009. Brothers Adam Pieratt and Justin Pieratt died when their car reportedly crossed the opposing lane and struck a car driven by Donna Hillard of Buchanan, Tennessee. Two passengers in the car, Caleb Rozet from Indian Mound and Christopher Rippy from Big Rock, survived and along with Donna Hillard were reportedly taken by Life Flight to Vanderbilt. Adam Pieratt was a senior at Stewart County High School and was scheduled to graduate on Friday before moving on to play college baseball at Columbia State Community College.

Cookeville TN Auto Accidents - Five Injured in Two Separate Crashes

Five people were injured in two separate car crashes in Cookeville, TN on Wednesday, May 20, 2009. Three were injured in the first: Meredith Jeanette Hudson, 39, and Kristen Hudson, 16, both of Lafayette, TN; and Jeffrey Richards, 42, of Cookeville, TN. Two people were injured in the second: J. Mackie, 54, of Cookeville, TN and Mary Flatt, 81, also of Cookeville, who remains in Erlanger Hospital in Chattanooga, suffered the most serious injuries according to the herald-citizen.com. Three of the victims were transported by medical emergency helicopters to Vanderbilt Medical Center in Nashville or Erlanger Medical Center in Chattanooga. The remaining two injured were transported by ambulance to Cookeville Regional Hospital.

One crash was on W. 12th Street (the Gainesboro Grade) near the city limits. The second accident occurred at the intersection of E. Hudgens Street and S. Maple Avenue in Cookeville.

The causes of the crashes have not yet been determined but both automobile accidents are still under investigation according to the Tennessee Highway Patrol (THP).

Garage Door Causes Death of Child Alleged in Lawsuit

The minor's death was due to compressional asphyxia after he was trapped under the garage door, according to the Cook County, IL's medical examiner's office. The young child had been playing outside by himself when his 9 year old brother found him fatally injured.

The suit filed in Cook County IL Circuit Court alleged that the garage door wasn't equipped with a motion sensor and that Washington failed to warn his relatives that it "could unexpectedly close or fall."

The lawsuit includes the installer and the manufacturer, Mid-America Door Co. and Sears, Roebuck & Co. as defendants.

The chicagotribune.com reported, "I'm haunted by this every day, and if I would have known he was under the garage door, then there's no way that I wouldn't have run to him," his mother said at a news conference. "I keep thinking that he was screaming and calling someone and no one was there to help him."

The U.S. Consumer Product Safety Commission requires garage door openers to have devices that reverse the door when it comes into contact with a person or object.

Medical Malpractice - Nerve Severed Ends in $4 Million Jury Verdict

The patient Robert T. Baird Jr. of Providence, RI filed the medical malpractice suit against Dr. Kenneth J. Morrissey the orthopedic surgeon alleging the doctor's negligence. Dr. Morrissey denied all allegations of negligence. The jury sided with the patient Baird, awarding $1.5 million for physical pain, $1.5 million for mental suffering, $500,000 for disfigurement and $500,000 for lost wages.

Baird began experiencing extreme pain in his right arm in 1999. He went to Morrissey, who made the decision to operate to improve Baird's movement in the upper extremity and in the process remove a benign tumor. Morrissey proceeded with the operation and within weeks, Baird's right hand began hurting, changing color, changing temperature and sweating.

Another orthopedic suregon, Dr. Manuel DaSilva diagnosed Baird as having Reflex Sympathetic Dystrophy Syndrome, a chronic neurological disorder that causes severe pain. Dr. DaSilva performed a second operation and discovered that another nerve had been severed during the previous operation performed by Dr. Morrissey. Again, Dr. Morrissey's position was that he was not negligent in cutting the nerve although he never meant to cut that particular nerve. His attorneys argued, "that's just a risk a patient takes."

Baird's hand since has seized into a claw and he remains in continuous pain. His attorney said that he would much more be working than get any amount of money awarded to him as the result of this needless injury and disability.

Medical Malpractice Victim Awarded $12 Million in Chattanooga

A Hamilton County jury awarded $12 million in damages suffered by a young woman due to the medical malpractice of a local physician. The judgment against a prominent Chattanooga doctor, stemmed from a procedure intended to diagnose bowel problems which left a young woman so brain damaged she can no longer care for herself.

Timesfreepress.com reports that the victim of this medical negligence, 33-year-old Kristen Freeman had been having bowel trouble for years. Ms. Freeman, who worked as an interior designer, scheduled an appointment with Dr. Michael Goodman, a gastroenterologist with a private practice in the Medical Mall at Erlanger Hospital. On April 27, 2006, Ms. Freeman went in to have a colonoscopy and upper endoscopy. These procedures were to be used to diagnose any possible disease of the small intestine or colon.

It was later found that the endoscopy caused a tear in the area of her small intestine just below her stomach.

By 5 p.m. the same day as the procedures, Ms. Freeman was experiencing extreme pain and constantly vomiting. She called Dr. Goodman's office but was only given a prescription for anti-nausea medication.

The next morning Ms. Freeman called Dr. Goodman's office to complain again of her symptoms of terrible abdominal pain and constant throwing up. She was recommended to go to Erlanger Emergency room to have X-rays performed. By the time she reached Erlanger on April 28, 2006, Ms. Freeman was so weak that she was required to use a wheelchair upon being admitted.

It was the position of Ms. Freeman's attorneys that Dr. Goodman should have known by the patient complaining of vomiting and pain that the condition required immediate attention. These symptoms are very indicative of the most dangerous complication of a perforated intestine from the colonoscopy and endoscopy procedures.

Dr. Goodman contended that Ms. Freeman should have known on her own to go to the emergency room. The lawyers for the gastroenterologist argued the when she started vomiting and experiencing pain almost immediately after having a colonoscopy and endoscopy done she should have known to go to the E.R. Ms. Freeman had no prior medical training. Dr. Goodman himself never told Ms. Freeman to go to the emergency room. All communications with his patient after the procedures were through his office staff.

As a result of the complications of the endoscopy and colonoscopy, Ms. Freeman suffered cardiopulmonary arrest and severe brain damage. This condition resulted in her permanent and total disability, according to court documents. Read the article here...

Colgan Air Flight 3407's Captain Caused Crash - NTSB

Colgan Air Flight 3407's Captain did the exact opposite of what he should have done trying to pull out of a fatal stall that led to the crash near Buffalo on Feb 12, 2009.

Captain Wally Warner, who said he conducted more than 1,000 stall recoveries for the Q-400 test flights, was asked by Debbie Hersman, a NTSB board member, if pulling back the yoke, causing the plane to pitch upward, was the right action.

"No, the proper thing to do, as he had done the 1,000 times he put the Q-400 through its paces, was to lower the nose and increase power." Warner replied. "In my opinion," Warner testified, "even at the altitude the airplane was at, you could still lower the nose, increase the power and recover."

Earlier witnesses virtually ruled out another possibility, a tail stall. A NASA aerospace engineer showed a video, which Renlow viewed, showing a NASA test pilot recovering from a rare tail stall. What the NASA test pilot did to come out of the tail stall was what Renslow did: Jerk the nose of the plane up.

Why show the video, Ratavasky was asked, for a plane that does not encounter tail stalls?
"Making a pilot aware of the aerodynamics of an airplane is valuable," he answered.

Before the viewing of the final 2 minutes of Flight 3407's last landing of the day was played, Lorenda Ward, the hearing office and NTSB investigator in charge, allowed a minute for families who could not bear to watch the recreation to leave the hearing room.

The animation did not show the idle cockpit chatter (FAA Violation below 10,000 ft.) between Renslow and Shaw. There were other violations that Ward mentioned in her opening statement including sleeping in the crew rooms and commuting to work via a federal express flight the night before.

The animation began at 10:14 p.m., when the Q 400 was 2,300 feet above the airport. A minute later, the air traffic controller cleared the flight for landing. The flight crew put the landing gear down, and a few seconds later, the trouble began, when the stick shaker warning activated. The aircraft suddenly pitched up, it rolled to the left, rolled to the right.

The aircraft then started its deep descent as it plummeted to earth in Clarence Center. The animation ended at that point, and the next thing shown was an aerial view of the wreckage, only the blue Colgan tail recognizable.

Mark V. Rosenker, acting chairman of the NTSB, said the three-day hearing will be a continued search for the causes of the plane crash.

The NTSB, he said, holds these hearings and determines the cause of aviation accidents in the hopes of preventing future disasters.

Motorcycle Accident Deaths Rise in Tennessee

One in every seven fatalities due to crashes in 2008 involved a motorcycle rider. The Governor's Highway Safety Office Director Kendell Poole stated, "This steady increase over the past decade represents one of our greatest highway safety challenges." According to the Tennessean, Poole went on to say, "It is clear that drivers need to be extra cautious."

Cindy Davidson, with the Tennessee Motorcycle Awareness Foundation (TMAF) said, "Often the motorcyclist is not at fault in fatal crashes. Most car drivers aren't trained to look out for motorcycles." Davidson went on to say, that the most common response of the driver of an automobile involved with a motorcycle is, "I didn't see the motorcycle."

TMAF was formed by motorcycle riders who have either been in accidents themselves or have lost a loved one in a motorcycle crash.

Most drivers of automobiles do not realize that motorcycles have the right of way. The motorcycle organization teaches drivers to constantly be on the lookout for motorcyclist who they share the road with equally. A motorcycle can easily slip into a automobile driver's blind spot. Drivers should always actually look out the window before changing lanes.

"You want to be sure that one of us is not right next to you," Davidson stated.

Motorcycle Crash Kills Lebanon TN Police Officer

The BMW was driven by Jose Chavez of Lebanon. Charges against Chavez are pending. According to the Tennessee Highway Patrol accident report, investigators have ordered tests to see if he was under the influence of drugs or alcohol.

The Tennessean reports that the officer is survived his wife and three children. "Stone's death is the second tragedy to strike his family this year. Just three months ago, his father, Jeffrey Dean Stone, was killed in a motorcycle accident. Stone's father was only 50."

Funeral arrangements for Stone had not yet been scheduled Sunday. Bowen said more details would be available today.

"He will be missed," said Scott Bowen, Lebanon P.D. Chief of Police.

Flight 3407 of Continental - Colgan Air Investigation Intensifies

At the same time, the Federal Aviation Administration is reportedly investigating whether Colgan Air has over scheduled its pilots in violation of federal rules. It is unclear, however, whether the FAA's investigation is connected with the Flight 3407 crash in any way.

If either insufficient training, or pilot fatigue related to over-scheduling of pilots, turns out to be a cause of the crash, it would have important potential consequences for Colgan Air in terms of potential liability for the crash and death of 50 persons on board.

Generally, an airline can be held liable for the acts of its employees where the employees were negligent in performing their duties within the course and scope of their employment. In that sense, an airline's liability essentially hinges on whether their employees negligently carried out their duties.

On the other hand, if an airline has an inadequate training program or over scheduled its pilots, those would implicate direct actions on the part of the airline itself, for which it could be held liable regardless of whether the pilots themselves acted wrongly. It might also open the possibility of punitive damages against the airline, which are generally available to punish and deter similar future behavior.

The federal investigations surrounding Flight 3407 and Colgan Air are still ongoing, and we must wait to see how the facts in this case play out. If, however, it turns out that either inadequate training or over-scheduling of pilots factored into the Flight 3407 crash, Colgan Air would likely face substantially higher potential liability in connection with the crash.

Fatal I-40 Wrong Way Accident Near Nashville

Another fatal wrong-way crash reportedly took place in the Nashville, Tennessee area. A man from Centerville was reportedly driving the wrong way on I-40 and hit another car head on early in the morning on Wednesday, May 6, 2009. Unfortunately, the driver of the other car was killed in the accident. The wrong way driver had reportedly been drinking and has since been charged with vehicular homicide by intoxication. This is the latest in a series of tragic wrong-way collisions that have occurred on Middle Tennessee highways in recent months.

School Bus Crashes Into Tractor Trailer in White County TN

Ten students and the driver of a White County, Tennessee school bus were injured after their bus crashed into a tractor trailer on April 29, 2009. The school bus was carrying 28 students on McMinnville Highway near Sunset Drive, when the bus crashed into the semi truck. The driver and eight students were transported to the hospital by ambulance. Two students were taken by their parent's personal vehicle.

The White County school bus was driven by Edward Erger, of White County. The First Express tractor trailer was being driven by Jamie Smith of Antioch, Tennessee.

According to Trooper David Hickey with Tennessee Highway Patrol, the truck was making a left turn off of Sunset Drive, onto McMinnville Highway, when the bus struck it in the right rear.

The Tennessee Highway Patrol, White County Emergency Medical Services, Sparta-White County Rescue Squad, White County Sheriff Department, Sparta Police Department all responded to the accident.

Nashville Man Killed in Deadly Motorcycle-Car Collision

The Nashville City Paper reported that, "Stabile was riding a 2001 Harley Davidson motorcycle southbound on Clarksville Pike at 6:15 p.m. when he collided with a 1999 Buick Regal driven by Cynthia Barnett, 34, of Homeland Drive."

According to the Metro Police report, Barnett was traveling on Stevens Lane and crossed Clarksville Pike striking the motorcycle redden by Stabile.

The accident report did not reference drugs or alcohol being involved.

Child Boarding Bus Dies After Being Hit By Car in Warren County, Tennessee

The roadway also known as Highway 55 is west of McMinville.

The investigation into the wreck is on going, and criminal charges against the driver of the car are pending.

Fatal Car Accident On Highway 70 Claims Life Of Kingston Tennessee Student

An 18-year-old senior at Kingston High School was reportedly killed in a fatal car wreck on Highway 70 in Roane County on Tuesday, April 21, 2009. James Sams III was reportedly killed when his vehicle crossed the center line and collided with a Ford F-350 dump truck traveling the other way. The truck's driver, Brian Leach, was reportedly injured in the accident and taken to the hospital.

Wilson County TN Man Killed In Motorcycle Accident

According to the Wilson Post, the accident report filed by Trooper Raymond Gaskill of the Tennessee High Patrol the pickup was traveling east on Stewarts Ferry Pike and allegedly passed several vehicles on double yellow lines before striking Holloway's motorcycle, who was operating a 2005 Yamaha XVA motorcycle was turning into a driveway.

The motorcycle was sitting still when it was struck, by the truck the trooper said. The accident report also reported that Holloway was wearing a helmet.

Charges of vehicular homicide have been filed against Duffey, who was not injured in the deadly accident.

Trooper Gaskill noted in his report that alcohol was believed to be involved on the part of Duffey and a blood alcohol test was requested.

School Bus Crash In Loudon County Tennessee

A school bus reportedly crashed on Wednesday April 22, 2009. The Loudon County Tennessee school bus sideswiped a utility pole after running off a road. Seven of the twenty-five students on the bus were reportedly taken to the hospital. Fortunately none were seriously injured. The driver of the bus, Gary Keener, was reportedly cited in the incident and suspended by school officials pending an investigation.

Tractor Trailer Accident On I-65 In Nashville On April 21, 2009

A rear-end collision involving a tractor trailer happened early in the morning on Tuesday, April 21, 2009. The wreck happened on Interstate 65 in Nashville, south of Trinity Lane. The driver of a pick-up truck reportedly struck the semi truck from behind and went underneath the trailer, trapping the driver inside. The driver of the pick-up truck had to be cut out of his truck by emergency crews, and he was reportedly in critical condition following the accident.

Sumner County Head-On Collision Fatally Injures Two

A Sumner County head-on collision fatally injured two people and seriously injured another on Sunday April 19, 2009 according to wkrn.com.

The fatal wreck occurred in the community of Sideview, just north of Gallatin.

The Sumner County Sheriff's Office reported Jenilou Tincher of Macon County was killed. The department spokesperson further stated that it is believed that Tincher's vehicle crossed the center line of Highway 31E and hit an unidentified couple driving in the opposite direction.

The unidentified passenger in the second vehicle was also killed. The driver of the second vehicle was transported to Vanderbilt University Medical Center. His condition was not immediately known.

The cause of the crash remains under investigation by the Tennessee Highway Patrol. Read the article here.

Death Of Knox County Nursing Home Patient Reviewed By TBI

The Tennessee Bureau of Investigation is reportedly reviewing the March 2008 death of a nursing home patient as suspicious and is looking into the matter at the request of the district attorney general after the Knox County medical examiner labeled the death as a homicide. The patient died following a nine day stay at the nursing home facility. The autopsy report states that "because of the nursing home neglect, the manner of death is homicide." According to the autopsy report, the patient died of dehydration due to inadequate care following injuries from an automobile accident.

Nursing home neglect and abuse is a horrible problem that happens all too often in Tennessee nursing homes. In fact, Tennessee recently ranked near the bottom (47^th out of 50 states) by the Center for Medicare and Medicaid Services in their nursing home report. Peterbilt Layoffs in Middle Tennessee Impact Injured Workers

Three Nashville/Middle Tennessee area employers recently announced they were laying off employees. Peterbilt Motors Co. in Madison, Tennessee laid off 390 administrative personnel on April 8, 2009. Expo Design Center at the 100 Oaks Mall will begin laying off 82 employees on April 20. The store is closing and has recently been liquidating its inventory. In Lebanon, Tennessee, TRW Automotive U.S. LLC laid off 55 employees between April 8 and April 10, 2009.

Catastrophic Failure Caused Super Puma Copter Crash

The rotor blades detached from the helicopter and then struck the tail, cutting the tail and the pylon from the main fuselage. These findings were contained in the AAIB's interim report which is similar to the NTSB's preliminary reports, according to cnn.com.

The fatal helicopter crash killed all 16 aboard. It was located about 11 miles off the coast and was on it's way from a gas platform named, the Miller platform to Aberdeen, Scotland. The weather was reported as mostly clear skys and light winds at the time of the copter crashed.

The pilots made a mayday call 12 seconds after the co-pilot had radioed his arrival time to the controller. The radio controller tried to immediately to respond to the distressed call, but was unable to make contact, according to the cockpit voice (CVR) and flight data recorder (FDR).

The radar information available shows the personnel transport helicopter heading towards the coast at about 2,000 feet, then climbing to 2,200 feet before making a aggressive right turn before rapidly descending.

A witness on a supply ship which was nearby stated, "Immediately after impact, he saw the four main rotor blades, still connected at their hub, strike the water," the report says. "Around this time, he also heard two bangs close together.

The AAIB has issued a safety recommendation urging operators to run further checks and enhance monitoring of the gearbox on all AS332L2 Super Puma helicopters.

The helicopter's operator was Bond Offshore Helicopters.

Car Wreck On Highway 51 Near Dyer County Line Leads To Second Crash Involving Fire Department

A car wreck reportedly occurred on Highway 51 near the Dyer County line on Thursday April 9, 2009 setting up an unfortunate later accident involving a member of the Halls Fire Department.

The initial automobile accident happened when a driver going north on Highway 51 went partially into the median then crossed the highway and landed upside down in a field. While Tennessee Highway Patrol officers were completing their investigation of the wreck, members of the Halls Fire Department went down to the car to do a last inspection. One of the firemen then brought them back up to the highway in his pickup truck. After the others got out of his truck, the fireman pulled back onto the highway and was hit by a car with two children passengers inside.

The driver in the initial accident was taken to Baptist Memorial Hospital in Lauderdale County, as were the driver and two children passengers in the car that struck the fireman's truck.

Faulty Maintenance Cause of American Airlines Flight 1400 Fire

AMR Corp. the parent company of American Airlines was forced by regulators to ground planes last year for inspections not up to manufacturers' standards. The specific cause of the St. Louis fire was because maintenance workers repeatedly used a tool to manually start the engine, which use was strictly prohibited by The Boeing Company, the MD-82's, manufacturer.

It was reported by bloomberg.com that NTSB Acting Chairman Mark Rosenker told reporters, "You can't just be taking processes out of your hip pocket that are not the approved manuals, that are not the approved procedures, and expect to be able to get the appropriate results."

The NTSB found that the American mechanics had bent a component of the aircraft when they used the prohibited tool, which led to the Sept. 28, 2007 fire. The mechanics used the prohibited method because their co-workers had failed to detect a worn out filter that prevented normal starts. The mechanics mistakenly replaced a start valve six times in 12 days before the accident, without realizing the problem was the filter which was worn out.

The NTSB report stated that if American's own maintenance procedures had been followed precisely, the incident and potential tragedy would have been prevented.

The pilots in control of American Airlines flight 1400 never completed a checklist for engine-fire emergencies. This pilot error caused the blaze to last much longer than it would have had the checklist been followed. Bloomberg.com stated Rosenker said, "There were a host of serious problems going on in that cockpit" and ‘the problems, "when you added them all together, could have been extremely catastrophic."

The Allied Pilots Association believes the evidence pointed to failure to follow American's repair processes, "clearly compromising the effectiveness of their maintenance reliability program."

The NTSB also faulted American's maintenance-monitoring system for not detecting the flaws in their maintenance procedures. The safety board recommended that the carrier correct deficiencies in the so-called Continuing Analysis and Surveillance System.

Similar evaluations have occurred at Southwest Airlines Co. and Continental Airlines Inc.

Clarksville TN Woman Killed In Fatal Crash On I-24

Yamaha Rhinos Recalled by Consumer Product Safety Commission

The Yamaha Rhino ATV has been linked to 46 deaths and hundred of reported injuries due to rollovers during turns at relatively low speeds and on level terrain.

The repairs to be performed by Yamaha include the installation of a space bar on the rear wheels, the removal of the rear anti-sway bar, the instillation of half doors and the installation of more passenger handholds.

Owners of Yamaha Rhino models 450, 660, and 700, should stop using them immediately and call their dealer so schedule for the repairs to be made.

Second Super Puma AS332L Mark II Helicopter Crashes – 16 Feared Dead

The helicopter that crashed on April 1, 2009 was carrying 16 people when it when down off Scotland's Northeast coast. Eight bodies have been recovered and 8 more are missing. There is no evidence that anyone survived.

The Super Puma was operated by Bond Offshore Helicopters. Super Puma copters are regularly used to transport personnel to and from oil and gas drilling platforms.

Wednesday's crash is thought to be Britain's second worst helicopter incident in history in terms of the number of fatalities.

Second Wrong Way Nashville Crash In Two Days Results in Death

The accident happened around 2 a.m. on March 26, 2009. News Channel 5 reports, that Goodlettsville police received a call that a vehicle was traveling the wrong way on Vietnam Veterans Boulevard.

WSMV News Channel 4 reported, that according to officers with Metro Police, a SUV was traveling south on the northbound side of Vietnam Veterans Parkway around 2 a.m. The vehicle then entered I-65 via the on-ramp - putting the vehicle heading south on I-65 north. The vehicle then collided with a sedan.

There was one occupant in each vehicle and both lost their lives. It was not reported whether or not alcohol may have played a part.

Buffalo Flight 3407 All Over Again? Turboprop Icing Possible Cause for Montana Crash

"It's Buffalo all over again, or it could be," said John Goglia, a former member of the National Transportation Safety Board. "Icing, given those conditions, is certainly going to be high on the list of things to look at for the investigators." Yahoo News March 23, 2009.

Speculation over the crash of the single-engine turboprop Pilatus PC 12/45 aircraft, shifted to ice on the wings Monday after it became less likely that overloading was to blame.

While descending, the plane passed through a layer of air at about 1,500 feet that was conducive to icing because the temperatures were below freezing and the air "had 100 percent relative humidity or was saturated," according to AccuWeather.com.

Safety experts said similar icing condition existed when a Continental Connection Flight 3407's twin-engine turboprop crashed into a home near Buffalo Niagara International Airport last month.

Mark Rosenker, acting NTSB chairman, told reporters in Montana that investigators would look at icing on the wings as a factor. "We will be looking at everything as it relates to the weather," he told Yahoo News.

Jim Hall the Former National Transportation Safety Board (NTSB) chairman pointed out the similarities between the Butte, MT crash and a March 26, 2005 crash near Bellefonte, PA.

In both of those crashes the airplane involved was a Pilatus PC 12/45 and was on approach to an airport. In both cases there were reports of conditions conducive to icing at lower elevations. Also in both the Montana and the Pennsylvania tragedies, witness reported that the plane appeared to dive into the ground.

Hall also told Yahoo News, "I'm certain they are also going to look at the weather conditions at the time and the pilot's training," Hall said. He pointed to a recommendation on NTSB's "most wanted list" of safety improvements that FAA test the ability of turboprop planes to withstand a particular type of icing condition called "super cooled liquid drops" before certifying the aircraft design for flight. FAA officials have said they're working on that recommendation. "If you had some precipitation and the temperature was in the right range, that again is an area that investigators would look at," Hall said.

The PC 12/45 is certified for flight into known icing conditions, according to the manufacturers' Web site.

The Pilatus PC 12/45 in the Butte crash and the Bombardier Dash 8 involved in the Buffalo tragedy, like all turboprop planes, rely on deicing boots - strips of rubber-like material on the leading edge of the wings and the horizontal part of the tail - that inflate and contract to break up ice. That technology, which was introduced in the 1930's, isn't as effective at eliminating ice as the heated wings that jet airplanes use to eliminate icing form their wings.

Fatal Accident Involving Wrong Way Driver On I-24 Near Nashville

In the early morning hours of March 24, 2009, a vehicle reportedly driving the wrong way on the interstate crashed into another car on I-24 in Joelton, Tennessee. One person was killed and two others were injured. One of the vehicles reportedly contained a newlywed couple returning to Iowa from Florida. The wife was pronounced dead at the scene and the husband listed in critical condition. The other driver, from Clarksville, Tennessee, suffered minor injuries.

Work related injury kills a construction worker in Gladville just east of Nasvhille

A construction worker was seriously injured causing death by electrocution in Gladeville, Tennessee just east of Nashville.

On Monday a construction worker was killed by electrocution while working on a church expansion project in Wilson County Gladville, Tennessee which is just east of Nashville. With the Wilson Emergency Management Agency Station next door to the church and with immediate response the man's live was unable to be saved.

The Wilson Post reports that the two construction workers were in a bucket lift installing siding on the United Methodist Church in Gladeville Wilson County when the lift came into contact with a power line electrocuting both men. One worker was not seriously injured but the other construction worker died from the work related incident.

Middle Tennessee Electric Membership Corporation cut off the electricity to many businesses and homes in the area as a result of the incident.

It is reported by local law enforcement the injured construction worker was believed to be from Overton County.

Single Engine Turboprop Airplane Crashes in Butte, MT

The Mountain Standard reported that, "The aircraft had departed from Oroville, Calif., and the pilot had filed a flight plan showing a destination of Bozeman, about 80 miles east of Butte. But the pilot canceled his flight plan at some point and headed for Butte." There was not a distress call from the pilot and the plane did not have a "black box" flight data recorder nor was there a cockpit voice recorder or on the aircraft.

The National Weather Service's information available suggests that it was partly cloudy, the visibility was 10 miles and winds were blowing from the northwest around 10 mph at the time of the crash.

The PC-12, was described by several witnesses as "nose-diving" into a cemetery while on short final for Bert Mooney Airport in Butte, Montana. Although there was reportedly the potential for icing in a cloud deck at 1,500, the PC-12 is certified for known icing. The ground temperature at the time of the crash was 45 degrees when the accident occurred.

AVweb.com reports "Without knowing the baggage load on the aircraft (it was a ski trip) there is nevertheless less emphasis on the possibility of overloading since half the occupants were under 10 years old and some were babies and toddlers, the children of six adults on board who were university classmates and some of whom were part owners of the aircraft."

The Mountain Standard indicated that three families were on their way to a ski vacation at Big Sky Resort and their original destination was Bozeman, Montana, which is closer to the resort. The pilot diverted to Butte but the reason for the diversion is unknown at this time.

NTSB Wants Boeing 777 Engine Redesigned

The National Transportation Safety Board (NTSB) issued a safety warning for Boeing 777s powered by Rolls-Royce engines. The urgent warning was issued because two of the 777's have lost power during flights over the past year. One crashed while landing at Heathrow Airport in London, England.

The Seattle Post-Intelligencer on seattlepi.newssource.com reported that there are approximately 230 of the Jets in service with different commercial airlines around the world. Each of the jumbo jets can carry up to 350 passengers.

The NTSB wants the Rolls-Royce engine to be redesigned. The Federal Aviation Administration (FAA) would have to issue an order to force the redesign. At this point the FAA has not taken a position on the issue.

The FAA has recently issued an airworthiness directive which requires operators of 777's with Rolls-Royce engines to take preventive steps to lessen the chances that the engines will lose power in flight. Any redesign or recertification of the engine would be a lengthy process should the FAA decide to issue such a directive.

Rolls-Royse has indicated that they have already started redesigning the engines. They expect the new engine to be completely redesigned within the next 12 months.

The problem has been reported to be traced to ice clogging the engine's fuel lines.

The NTSB said that the procedures developed by Boeing and the FAA which are in an effort to reduce the risk of the engines losing power in cold conditions,, are simply not sufficient. Because the proscribed procedure requires a descent, the aircraft is exposed to other know risks of hazards. These risks include, that the aircraft may be exposed to rising terrain or hazardous weather or may encounter the inability to achieve the needed thrust during critical phases of flight such as going missed approach. The NTSB has determined that the only safe direction to take is to redesign the engine and specifically the problems with the fuel lines.

Franklin Tennessee Police Detective Vehicle Roll Over

A detective in Franklin Tennessee reportedly rolled over her vehicle after driving over loose gravel. The detective was traveling in Williamson County when the vehicle hit some gravel, and flipped over onto its roof. The officer reportedly was not speeding but was going the posted speed limit.

The U.S. Supreme Court ruled that the 3rd Circuit U.S. Court of Appeals has to reconsider its rejection of a false advertising suit over AstraZeneca Plc's Nexium anti-ulcer treatment.

The Supreme Court ruled in Wyeth v. Levine that Congress, in setting up the federal drug-approval system through the Federal Drug Administration (FDA), intended to allow traditional product liability suits, based on state laws, to be an additional layer of protection for pharmaceutical consumers.

The court stated, "Congress did not intend FDA oversight to be the exclusive means of ensuring drug safety and effectiveness,"

The lands highest court did not address the issue of whether doctors should be warned not to use a disputed injection method. The court also did not rule on the issue of whether a traditional products liability lawsuit based on state law would be allowed when it is centered on a proposed warning that the FDA considered and rejected.

Boeing 777's With Rolls-Royce Engines Have Big Problems

Two Boeing 777's with Rolls-Royce Engines have lost power during flights within a year.

The first of the two incidences happened in January 2008. It involved a British

Airways 777-200ER which was on approach Heathrow Airport in London, England when both engines failed to respond to auto pilot commands to increase thrust. That commercial airliner crashed short of the runway with 152 passengers plus crew members. There were several injuries but no deaths in that crash.

The second commercial aviation accident occurred in November of 2008, when a Delta Air Lines 777-200 lost thrust in one of it's Rolls-Royce engines over Montana. The crew followed the Boeing's and FAA's published procedure and the engine was successfully restarted. The airplane landed safely in Atlanta, GA.

In both incidences, investigators determined that the cause was the buildup of ice from water normally present in all jet fuel.

Boeing engineers, working in the laboratory, determined that the heat generated by the Rolls-Royce fuel-oil heat exchanger is not adequate to prevent moisture in the fuel from freezing. When that happens, ice can form that blocks fuel to the exchanger, starving the engines.

Antidepressant Suicide Lawsuits Revived by U.S. Supreme Court

Bloomberg.com reported that the high court told federal appeals courts that in light of the recent ruling against Wyeth, they need to reconsider their dismissal of the two cases. In the Wyeth case the Supreme Court made it easier for injured patients to sue drugmakers.

The two suits involving Zoloft and Paxil, stem from suicides of a man and a woman after each took one of the drugs.

The Wyeth case involved an anti-nausea drug that caused a death of a Vermont woman. Pfizer and GlaxoSmithKline say that their case is different. They contend that because the Food and Drug Administration (FDA) had considered suicide warnings for adult patients but rejected the idea, makes it a different situation that is not applicable to the Wyeth ruling.

Pfizer stated in a court filing that, " FDA repeatedly determined that the scientific evidence did not support such an association." The U.S Court of Appeals, Third Circuit in Philadelphia agreed with that argument holding that the FDA studied the issue for over 20 years and found that suicide warnings for adult patients, "are without a scientific basis and would therefore be false and misleading."

In 2005 the FDA required antidepressant drugmakers to include in their packaging, inserts to warn Doctors as well as their patients, about the risk of suicide among children. In 2007 the FDA extended this requirement of a warning to patients aged from 18 to 24.

State of Tennessee to Inspect Amusement Park Rides

Inspectors for the State of Tennessee will conduct random inspections at amusement parks, fairs and carnivals this summer to insure the safety of the riders.

The random inspections will be conducted twice yearly at stationary parks such as Dollywood in Pigeon Forge, TN. The inspections will be totally random and unannounced for traveling carnivals and fairs such as the Tennessee State Fair in Nashville and the Wilson County Fair held in Lebanon each year.

If one of the inspectors considers a ride unsafe, it will be shut down until repairs are made.

Hundreds of amusement park ride accidents are reported across the country.

Thirty-eight riders were stranded atop the 65 foot Timber Tower ride at Dollywood in 2007. Luckily, there were no injuries from this incident which was due to the malfunction of a safety system. However, it took six hours to evacuate all 65 of the terrified riders.

Also in the summer of 2007, a 13 year old girl had both feet severed when a gondola cable snapped while she was riding the 177 feet high Superman Tower at Six Flags in Louisville, KY.

This new law went into effect January 1, 2009. Lawmakers hope to prevent injuries and death for these unsafe amusement rides. The new state law also requires the owners of the rides to keep the rides insured, to obtain an annual permit for operation, and to certify that their operators have been properly trained.

These mandatory inspections do not cover wave pools, go-karts tracks, skateboard ramps and bungee cord rides not associated with a carnival, fair or amusement park.

US Supreme Court Rules in FDA Pre-emption Case

The United States Supreme Court has ruled that just because the federal government regulates an industry, citizens should still be allowed to sue a company within that industry in state courts.

By a vote of 6-3 the court ruled against Wyeth in a case closely watched, not only by the drug industry but by all industries regulated by the federal government. Wyeth argued that federal regulations placed on industries by federal agencies such as the Food an Drug Administration (FDA) should trump state law cause of actions. The pharmaceutical giant had argued that if drug makers follow the rules established by the FDA, patients should not be able to sue in state court.

The Wall Street Journal reported that the court rejected that argument stating that, "We conclude that it is not impossible for Wyeth to comply with its state and federal law obligations,"

Wyeth said that they believed that Federal law prohibited the company from revising the lable of the drug as Vermont law required. The company stated through their attorney that the medical experts at the FDA were in the best position to, "...weigh the risks and benefits of a medicine and to assess how those risks and benefits should be described in the product's label."

Levine's attorney said, "The Supreme Court's opinion reaffirms the important role state law plays in promoting consumer safety and providing compensation for injuries. More importantly, the decision permits Ms. Levine to put this chapter behind her and to move on with her life."

Plane Crash Near Carrollton, GA Kills Three

A 1975 Cessna 182, single engine, four seat airplane crashed in a lake near Carrollton, GA on March 8, 2009. It had taken off from Cobb County Airport-McCollum Field heading to the NASCAR race in Henry County, GA and was to land at the Clayton County Airport-Tara Field next to the racetrack. The Atlanta Journal-Constitution, reports that three people were believed killed.

Searchers found the bodies of a man and a woman at the crash site which was in Shadinger Lake in Carroll County. The third body was still missing Sunday night. The names of the victims were not available Sunday night.

One witness that lives near the lake said she heard the planes engine sputtering and sounded like it was coming through her bedroom window. The impact of the aircraft crashing into the lake caused ocean like waves she said.

Divers were called in from Spalding County, GA to assist in the recovery.

The small airplane had a registration number of N1913M and did not file a flight plan. It is not unusual for small aircraft to not file a flight plan on short trips when the weather is not a factor with the flight.

Investigators for the National Transportation Safety Board (NTSB) will determine a probable cause of the crash.

After Flight 3407, Clarence, NY Finds Ways to Ease the Pain

David Gardner of Clarence, NY found a way to help ease the pain for the families of Continental Connection Flight 3407. He designed a fund-raising T-shirt with a broken heart and a Band-Aid.

The tragedy that claimed 50 lives has been the inspiration for several projects to help and to support the surviving families. These projects range from the heart T-shirts to light pole banners to raising money for a town clock honoring the victims of the crash.

Other projects include a race and concert in June at the Clarence Center Fire Hall. Some volunteers have made plans to take down the ribbons on trees and telephone poles when they become worn and local florist have already agreed to replace them. The ribbons are black, for sorrow and white for hope.

The workers at the new Buffalo Shirt Factory made the broken heart T-shirts donated their time to produce the shirts. The Buffalo News reported that Gardner, the shirt designer stated, "I think it gives people maybe a jumping-off point. It's hard to even broach the subject," he said. "I think that's the only way you do heal . . . You find that sharing it with other people is a way to come to peace with it yourself."

Boeing Issues Memo on 737 Jets After Turkish Airlines Flight 1951 Crash

The Turkish Airlines1951 from Istanbul to Amsterdam dropped from the sky on approach to the landing strip broke into three pieces near Schiphol Airport in the Netherlands on February 25, 2009. Eighty people were injured in the crash.

The Boeing 737 is the most widely flown jet in commercial aviation. More than 6000 are currently a part of commercial fleets around the world.

According to CNN.com, Jim Proulx a company spokesman said, "Boeing reminds all operators to make sure flight crews pay close attention to all primary flight controls during critical stages of a flight."

The memo states that there was a malfunction of one of the planes altimeters. An altimeter measures altitude above the ground. One of the two altimeters was giving erroneous information, which indicated that the aircraft was 7 or 8 feet form the ground when it was actually about 2,000 feet in the air. The plane was on automatic pilot and the erroneous reading caused the automatic throttles to decrease the planes air speed.

The memo recommends that operators inform their flight crews of the details of the investigation and remind them to carefully monitor their primary flight instruments.

This is not the first incident of this problem with the Boeing 737. Two other flights of 737 aircraft had experienced the same faulty readings, but the pilot in those landings were able to successfully make the landings. The head Dutch investigator said that the automatiac pilot should not be used if there is a threat of the altimeter malfunctioning. In the Amsterdam crash the pilots did not recognize the malfunction until they were too low to recover.

CNN.com further reported that, the Boeing memo notes that "the autothrottle, which uses the left radio altimeter data, transitioned to landing flare mode and retarded the throttles to the idle stop. The throttles remained at the idle stop for approximately 100 seconds during which time the airspeed decreased to approximately 40 knots below the selected approach speed."

Continental Connections Flight 3407 Is One of the Most Deadly Crashes in American History

According to the Buffalo News, the Continental Connections Flight 3407 tragedy ranks as the 22nd most deadly crash of American commercial flights during the past 30 years.

The Feb. 12 crash in Clarence which claimed 50 lives is among the top three aviation disasters involving prop planes.

One of the two other worst propeller driven airplane crashes was in 1985 outside Reno, NV and the other was in 1993 in Indiana.

If icing was a cause in the Buffalo disaster of flight 3407, it will be included in 12 such icing related accidents over the past 30 years. Of those 12 icing related crashes, 8 involved propeller planes. One half of the fatalities of those 12 icing related crashes, included 471 fatalities and turboprops were involved in one half of those tragedies.

Although it is too soon for the National Transportation Safety Board to determine, icing and pilot error are the two most likely causes of the crash according to the article. The article also points out that, "Of the 25 most deadly plane crashes in the past 30 years, three were blamed, at least in part, on icing. "

The most deadly of these accidents caused by icing occurred aboard the Arrow Air military charter, Flight 1285, carrying 101st Airborne Division soldiers. The flight was returning the soldiers to Fort Campbell, Kentucky for the Christmas holiday when it crashed shortly after take off in Newfoundland, Canada. The soldiers had been peacekeeping mission in the Middle East. All 253 on board were killed. Icing was found to be a contributing factor of that crash.

Another icing accident involving a jet occurred Jan. 13, 1982, in Washington D.C. Air Florida Flight 90 was on takeoff heading to Fort Lauderdale, FL when shortly after takeoff, the Boeing 737 fell from the sky, hitting a bridge before plunging into the Potomac River, killing 78 people. The cause of that crash was found to be improper use of deicing equipment prior to the attempted takeoff.

While jet planes are not immune to icing problems and tragedies, turboprops are more vulnerable because of their lack of de-icing features.

Landing Gear of Continental Connections Flight 3407 Also Under Scrutiny

The Buffalo News reports that while National Transportation Safety Board (NTSB) investigators have discussed icing on Continental Connections' Flight 3407 wings, as well as possible pilot error, as possible causes, the landing gear may now be under scrutiny.

The Bombardier Dash 8 Q400 that crashes in Clarence outside of Buffalo last week has a relatively good safety record here in the United States. However, abroad it does not enjoy the same safety record. Many of these close calls overseas involved the landing gear.

The Q400 aircraft was introduced in 2000. A review of the Federal Aviation Administration's (FAA) records indicate that throughout the United States, there were 11 reports filed about other Q400 planes. Worldwide, there were 80 such reports. The Q400 plane involved in the Feb. 12 crash had no prior accidents or serious incidents.

Eurocopter Super Puma Helicopter crashes off Coast of Scotland

Aberdeen, Scotland - A Eurocopter Super Puma helicopter crashed about 120 miles east of Aberdeen, Scotland. All eighteen people aboard were recovered by the Royal Air Force, alive and with no serious injuries. The eighteen consisted of sixteen passengers and two crew members.

It was reported that the copter was approaching or attempting to land on an offshore oil drilling platform. There was some fog in the area but it is not known at this time if it was a contributing factor to the crash.

Five emergency rescue helicopters were dispatched towards the emergency beacons being transmitted from the lifejackets of the eighteen people.

The Super Puma is regularly used in the oil and gas drilling industry to transport personnel to and from offshore platforms. It is thought that the Super Puma has a good safety record.

Turkish Aerospace Industries (TAI) and Eurocopter have formed the EUROTAI Consortium. Under this venture agreement TAI will manufacture the Eurocopter Super Puma and Cougar in Turkey

Carriers Other Than Contential Had Stoped Using Prop Planes in Cold Weather - Flight 3407

Two other carriers stopped flights of turboprop planes in cold weather before the Continental Connection Flight 3407 crash in Buffalo.

Unlike their counterparts, Colgan Air, a commuter carrier for Continental Airlines chose to continue to fly turboprops from Newark to Buffalo. Jim Hall, the former head of the National Transportation Safety Board said that the lessons learned from these earlier crashes should have prevented the Colgan crash.

Hall indicated that this crash was more tragic than most because it was very foreseeable and likely preventable. In his opinion the airline had preferred their profits over that of the safety of the passengers. He furthermore placed blame on the aviation industry and the Federal aviation Administration for their failure to adequately address the know safety risks associated with icing.

In 1994 an Americian Eagle turboprop went down in icy conditions in Indiana. That flight was en route from Indianapolis to Chicago when the pilots lost control because of ice accumulation on the wings. The ATR 72-210 turboprop was not well equipped to handle icing and crashed in Roselawn, Indiana. After that the airline made the turboprops their Caribbean fleet.

On January 9, 1997 a Comair flight from Cincinnati to Detroit crashed nose first 18 miles short of the runway in Detroit. Twenty nine souls were lost in that tragedy. Thereafter Comair eliminated turbo props from their fleet and replaced them with Bombardier regional commuter jets.
Puneet Singla, Ph. D. an assistant professor of mechanical and aerospace engineering at the University at Buffalo, stated that turboprop planes are more dangerous than jets in icy conditions. The wings of turboprop aircraft are far more likely to encounter icing problems.

There are two primary reasons for the increased danger. First, turboprops fly at a lower speed, making it easier for ice to accumulate. Second, turboprops fly at lower altitudes where icing is more likely to occur.

The Bombardier Dash 8 Q400 turboprop aircraft involved in the crash was equipped with pneumatic deicing boots which is a technology invented in the 1930's. Heated wing technology used by jets is much more effective in controlling icing on wings.

Hall who headed the NTSB from 1994 through 2001 stated, "The FAA should ground all aircraft of this type until the NTSB investigation is completed and it is clear they can be operated safely."

The Bombardier Dash 8 Q400 turboprop aircraft involved in the crash was owned by Pinnacle Airlines and operated by it's subsidiary Colgan Air.

US Customs Chopper Crashes Near Onofre, CA

Los Angeles, California - A helicopter that belonged to the Air and Marine unit of the U.S. Customs and Border Protection experienced an emergency while on patrol between Long Beach Airport and San Diego. The McDonnell Douglas 600N, made a forced landing on the beach near Onofre, CA because of engine trouble.

The L.A. Times reported, that the three crew members on board were able to exit the aircraft on their own are being treated for non-life threatening injuries.

The National Transportation Safety Board is investigating.

Motorcyle Crashes Into Police Car In Middle Tennessee

A motorcycle accident reportedly occurred when a motorcycle crashed into a Franklin Tennessee police officer who was responding to a service call. The officer was reportedly driving through an intersection with his lights and siren activated when a motorcycle struck his police vehicle. The police department reportedly requested that the Tennessee Highway Patrol investigate the accident.
