That’s right! No matter how unreasonable the workers compensation insurance company has been, the judge will never know it. The workers compensation insurance company’s lawyers will do everything they can to make you look like a money-hungry worker out to get rich by filing a workers compensation claim. It is neither relevant nor admissible into evidence at trial, the unreasonable things may the insurance company has done in the course of settlement negotiations that forced you into having to file a workers compensation claim in the first place. This rule of evidence is based on the thought that if parties know that offers of settlement discussions will be used against them, they would never make offers and virtually every workers compensation claim would end up going to trial.
