Garage Door Causes Death of Child Alleged in Lawsuit

A faulty garage door caused the death of a 6 year old child when it closed on him, according to a lawsuit filed by his parents.  The lawsuit alleges was filed against the homeowner, the installer of the garage door and the manufacturer of the garage door.

The minor's death was due to compressional asphyxia after he was trapped under the garage door, according to the Cook County, IL's medical examiner's office.  The young child had been playing outside by himself when his 9 year old brother found him fatally injured. 

The suit filed in Cook County IL Circuit Court alleged that the garage door wasn't equipped with a motion sensor and that Washington failed to warn his relatives that it "could unexpectedly close or fall." 

The lawsuit includes the installer and the manufacturer, Mid-America Door Co. and Sears, Roebuck & Co. as defendants.

The chicagotribune.com reported, "I'm haunted by this every day, and if I would have known he was under the garage door, then there's no way that I wouldn't have run to him," his mother said at a news conference. "I keep thinking that he was screaming and calling someone and no one was there to help him."

The U.S. Consumer Product Safety Commission requires garage door openers to have devices that reverse the door when it comes into contact with a person or object.
