Toyota's recent problems with recalls due to uncontrollable acceleration have spured the filing of a class action lawsuit by attorney Keith Williams, of Lannom and Williams in Wilson County, who is representing a Lebanon owner of a 2009 Toyota Camry.
The lawsuit will not be for damages or injuries resulting from the vehicles, but the loss of resale value that the malfunctions have caused.
Toyota's President testified before Congress that the company was aware of the malfunctions for several years and chose not to disclose this knowledge to the public. This fraudulent misrepresentation by the company likly influenced buyers of Toyota vehicles to choose vehicles that they would not have purchased if they had been informed of the malfunctions.
Toyota vehicles involved in the recalls have suffered a significant drop in resale value and Keith Williams believes that these owners deserve an opportunity to reclaim the financial damage they have realized.
Additional plaintiffs may also join the case before the lawsuit is filed. According to Williams the lawsuit will ask the court to certify the case as a class action on behalf of all Toyota owners in Tennessee and appoint his client, the owner of a 2009 Toyota Camry, as the representative of the class.
