Toyota’s former head lawyer alleges cover up by company.

Toyota’s former head lawyer, Dimitrios Biller, has filed a lawsuit against the company accusing it of conspiring to withhold evidence in rollover cases and then forcing him to resign.

Biller claims that Toyota had a database known as the, “Book of Knowledge,” that listed all of the design flaws as well as “countermeasures” used to resolve the problems.

Biller discovered the database while working on a case and claims to have warned Toyota that the database should be released during litigation but Toyota’s management refused.

 Owners of Toyota and Lexis vehicles involved in the recall that have not been injured by the flaws in these vehicles may have overlooked the fact that they might have lost a large piece of their investment in their vehicle due to a drop of the fair market value related to the intentional concealment of these problems.

Under the Tennessee Consumer Protection Act, if a seller or manufacturer intentionally conceals a known defect of a product, the consumer may be entitled to: 1) actual damage for the decrease in the value of their vehicle; 2) three times the actual damage as punishment to the manufacturer; 3) attorney fees and  4) the cost of litigation.
