Workers Compensation

Because work related injuries are so common, Tennessee construction employers and employers with five or more employees are required to keep workers’ compensation insurance to compensate those who are hurt on the job. Tennessee Workers’ Compensation Laws entitle individuals who have suffered a permanent work related injury—regardless of severity—to compensation for their medical expenses and other losses. Recovering damages through workers’ compensation, however, is often a long and complex process due to the recent changes in the Tennessee Workers’ Compensation Laws. What Does Workers’ Compensation Cover?

 

Workers’ compensation covers most work related injuries, including those sustained while on a break.   Common injuries covered by workers’ compensation include:

 

  • Physical injuries caused by accidents or unsafe working conditions
  • Repetitive stress injuries such as carpal tunnel syndrome
  • Preexisting health conditions worsened by working conditions
  • Physical or mental strain caused by work-related stress 

Recoverable Damages?

    Those who suffer work related injuries may be eligible to recover medical expenses, lost wages, decreased earning potential, and more—through workers’ compensation insurance. The dependants of those who die as a result of a work related injury may also be entitled to seek compensation under Tennessee Law. 

The primary benefits recoverable are medical bills, past and future, temporary partial disability, and permanent disability.

 

    • Medical benefits for emergency care and medical treatment authorized by workers’ compensation insurance are covered.  In some cases, if the insurance company denies the employees’ claim for medical benefits, expenses for unauthorized treatment may be recovered. In most all cases, an injured employee will receive future medical treatment for work related injuries.
    • Temporary partial disability benefits are available to injured workers taken off work by the authorized treating physician until being released by the doctor to return to work; there are time limitations that apply to receiving temporary benefits.
    • Permanent disability benefits are available when the work related injury results in a permanent injury.  Tennessee law is intended  to compensate an employee for the loss of earning capacity due to permanent work related injury.
    • Benefits are available for injured workers unable to return to any work due to their work related injury.  These benefits are referred to as permanent total disability benefits and may continue until the employees’ date of Social Security old age retirement.
