Americans are living longer than ever before. The fastest growing segment in the United States is the elderly population. As a result of this demographic shift, many elderly Americans have become residents of nursing homes during their final years. Placing a loved one in a nursing home is a never an easy thing. Nevertheless, there often comes a point where it is the only option for many families. When the time comes, we want to know that our loved one is receiving a high quality of care and, equally important, we want our loved one to be treated with dignity and respect.

Unfortunately, it doesn't always work out that way.

Many of these nursing homes are under-funded, understaffed and that staff is undertrained. To further complicate this situation our elder loved ones are often unwilling or afraid to report neglect or abuse.

Nursing home neglect includes:

• Failure to assist in personal hygiene
• Failure to provide appropriate food, clothing and shelter
• Failure to provide appropriate medical care
• Failure to prevent or treat malnutrition and dehydration
• Failure to prevent falls

Nursing home abuse includes:

• Development of bed sores and ulcers
• Excessive and/or rapid weight loss
• Broken bones and/or unexplained falls
• Open wounds, cuts, bruises, or welts
• Unexplained or unexpected death Injuries resulting from restraint or lack of restraint

If you suspect that someone you love has been injured as a result of nursing home negligence or abuse, it is important to immediately document and report the problem. Put your report in writing, date it, and keep a copy. Make your report to the facility's administrator, director of nursing, and social worker.

Residents Rights

Our loved ones also have patient rights under State and Federal laws. The nursing home must list and give all new residents a copy of these rights. They include:

• Respect: They have the right to be treated with dignity and respect.
• Services and Fees: The loved one and the family must be informed in writing about services and fees before you enter the nursing home.
• Money: The resident has the right to manage their own money or to choose someone else they trust to do this for them.
• Privacy: They have the right to privacy, and to keep and use their personal belongings and property as long as it doesn't interfere with the rights, health, or safety of others.
• Medical Care: They have the right to be informed about their medical condition and medications, and to see their own doctor. They also have the right to refuse medications and treatments.
