Study: Doctors Have Advantage in Malpractice Cases

Research conducted by a University of Missouri – Columbia law professor found that juries are more likely to side with doctors in malpractice cases. The study indicated that juries tend to be skeptical of persons who sue their doctors and that most trial cases end in a defense verdict. Data for the study were collected from cases in New Jersey, North Carolina, Florida and Michigan.  Charles Toutant, Law.com  04/26/2007

 

Jury Awards Texans Involved in Fatal SUV Wreck

Allied Van Lines must pay a group of Texans $31.8 million after one of their moving vans collided with an SUV killing five of the passengers involved. Nearly 70 percent of the award will go to the two surviving SUV passengers to cover medical expenses, lost earning capacity, disfigurement and pain and suffering. An attorney in the case considered the verdict unusually large for a damage suit that was not a class action.  The Associated Press, Houston Chronicle  04/12/2007


 

Jury Finds Against Physician's Group in Defamation Case
 A TX doctor was awarded $6.3 million in a lawsuit accusing a physician's group of defamation. According to the suit, the group retaliated against the doctor when they fired him for complaining about managing practices. Makers of Splenda Accused of False Advertising
A lawsuit against McNeil Nutritionals, the makers of Splenda, alleges the company set out to mislead and confuse consumers with their advertising campaign. The company's marketing falsely suggests the product contains sugar and is natural, according to their competitors. The lawsuit focuses on the product's slogan: "made from sugar so it tastes like sugar."  Shannon P. Duffy, Law.com  04/11/2007
