What Tennessee Insurance Agent Negligence Means to Policy Holders

Insurance policies are designed to protect the people who sign up for them. The most common policies are for auto insurance, life insurance and home insurance. Clients of insurance companies pay for peace of mind, so that after a car accident, a tornado, a death in the family, or any other calamity, they are protected for further harm. People don’t want to worry about money when there’s a hardship in their lives—large or small.

Like everyone, insurance agents aren’t always perfect. Papers get lost, forms don’t get signed, agents forget to look at additional assets, or agents can forget details that can cost clients their coverage. But when this happens, the clients aren’t responsible. This is insurance agent negligence, and the company has to pay when they neglect their responsibilities to their clients.

If a client signs up for a $25,000 auto insurance policy because he assumes his policy will only need to cover liabilities involving his vehicle, his insurance agent has neglected to provide him with adequate insurance. If an accident occurs and the client is responsible, the victim of the accident can actually sue, leaving all of the client’s assets unprotected. This includes the client’s house, property, 401k, retirement and future pay.

If the insurance agent failed to incorporate all the holdings of the client, the client could face insurmountable financial problems. No matter what the outcome of the case, the fact that his agent didn’t fully research the client’s needed coverage is an example of negligence and the client can sue for proper coverage.

An insurance agent has a duty to his client to protect all of his assets. When a client asks for a policy, his agent is responsible for looking out for his best interests. The agent isn’t supposed to just show some numbers and agree on a policy, he is supposed to consider everything the client has as assets and protect them.
