Medical Malpractice

Nashville Medical Malpractice Attorney

When a medical professional makes a mistake, it poses an unacceptable risk to you and your family.

  • A pharmacist in Nashville makes a medication error and your husband dies of an overdose.
  • A Tennessee doctor fails to diagnose your wife’s breast cancer soon enough to save her life.
  • Your mother or father never woke up from a routine surgery at the hospital in Hendersonville because of a mistake with the level of anesthesia.
  • Your child suffers from Erb’s palsy because of a birth injury.
  • You spend days in a Davidson County hospital before a major surgery, only to stay for painful weeks and subsequent surgeries because the surgeon made a mistake and left a foreign object inside of your body.

We’re all human. People make mistakes. That doesn’t mean your family has to suffer in silence.

Medical professionals carry malpractice insurance because families clearly have a right to fair compensation when something goes wrong. An attorney can assist and protect you and your family through the difficult process of filing a malpractice claim.

Medical Malpractice Frequently Asked Questions

What is medical malpractice or a medical error under Tennessee law?

In Tennessee, medical malpractice or a medical error occurs when some part of a medical care plan is not followed or when the wrong plan was used in the first place. As many as 98,000 people die each year in the United States due to medical malpractice and medical errors. It has been estimated that at least 2000 Tennesseans die each year due to medical malpractice and medical errors. Sometimes these medical errors are not discoverable until a long time after the actual error occurred (ie a foreign object is left in an incision and problems do not occur until months later).

What are common defenses to a medical malpractice lawsuit in Tennessee?

The doctor, nurse or other healthcare provider did not deviate from the required standard of care for the medical procedure.

Any deviation from the required standard of care did not cause the damage or injuries complained of by the victim of the medical malpractice.

The damage or injuries were an accepted risk of the medical procedure.

The victim of the medical malpractice was partially or entirely at fault for their own harm, loss and damage.

The damage or injuries were caused by the medical negligence of someone other than the medical provider which you are claiming the harm and damages.

Can cerebral palsy be caused by medical malpractice?

Yes.  If the medical negligence of a medical provider leads to a lack of oxygen  to a child’s brain (such as through strangulation),  it quite possibly could result in cerebral palsy.  Unfortunately, there is no cure for cerebral palsy.   It is a devastating medical condition that sadly, the child is forced to deal with for the rest their life.

How long do I have to file a lawsuit in a Tennessee medical malpractice case?

You have one (1) year from the date you are injured to file a medical malpractice suit in Tennessee.  This time limitation in which you have to file suit is called the Statute of Limitation.  If the injury is not discovered when the medical negligence occurs, the Statute of Limitation is one (1) year from the date you discovered or should have discovered the medical malpractice.  In any event, the lawsuit must be filed within three (3) years of the negligent act or omission.  This three (3) year time limitation is called the Statute of Repose.  An exception to the three (3) year Statute of Repose is in the case of the medical provider’s fraudulent concealment of their wrongdoing.  Statute of Limitation and Statute of Repose issues can be complicated.  If you think you may have been a victim of medical malpractice in Tennessee, it is very important to act very quickly to protect your and your families’ rights.
